 Personal liability
 ○ Where the liability exceeds the limit of the underlying policy and the underlying insurer has:
– Paid a valid claim in terms of the policy.
– Admitted liability to a valid claim in terms of the policy.
– Been held liable by a court of law to pay up to the limit of the underlying policy.
○ Legal costs and legal expenses that a claimant can recover from you for a valid claim under this benefit on condition that we have agreed in writing to cover these costs, prior to the costs being incurred .
○ Legal liability for pollution or contamination during the period of insurance on condition that it happens unexpectedly and unintentionally at an identifiable time and place.
The following conditions of cover apply:
○ You must have an underlying policy that covers precisely the type of liability that you are claiming for.
○ You must have complied with the conditions of the underlying policy.
○ The underlying policy must provide cover up to a limit of at least R1 million, and R2.5 million for motor liability.
Limit of liability
The limit shown in the policy schedule is the maximum amount that we will pay for any claim under this benefit for any single claim, any series of claims from the same event, or all events during the period of insurance.
Territorial limits
You are covered for liability claims which are made against you anywhere in the world, except if the liability claim, award, settlement, court or enforcement order is made in the United States of America (USA), Canada or any other country which operates under the laws of the USA or Canada.
Exclusions
We will not pay a claim for liability that was caused by, or related to any of the following Specific exclusions:
○ Your employment, business or profession: Including if you sell anything or provide any type of service for payment unless you have selected:
– Business liability cover under the Personal Liability section.
– Extension of liability cover under the Motor section.
– Bed & Breakfast cover under the Household contents section.
○ Hiring, leasing or borrowing of your property: We do no cover any of your movable or immovable property hired, leased or borrowed for money or any other benefit unless it is a building or structure, including the land on which is situated, used as a private residence covered by the underlying policy.
○ Buying, selling or swapping any movable or immovable property. This includes cash or credit sale agreements, theft under false pretences, fraud and any resultant liability.
