 Subject to the observance of these warranties the insurance shall not be invalidated by the failure of a water supply from circumstances outside the control of the Insured provided that such failure shall be rectified as soon as it comes to the Insured’s knowledge or if it cannot be rectified the company be advised in writing thereof.
Subject otherwise to the terms, exceptions and conditions of the policy."
5.4 Gas installations
5.4.1 Only certified installers should be used to do installations.
5.4.2 Obtain a certificate of installation.
5.4.3 The following warranty must apply:
"It is a condition precedent to liability that all gas installations at the insured premises must adhere strictly to the SANS 100087 – 1 Code of Practices, specifications and/or standards and any subsequent amendments thereto."
5.5 Lightning conductors and surge arrestors
5.5.1 This is applicable to all electronic equipment insured under the Fire, Office Contents, Buildings Combined, Business All Risks and Electronic Equipment sections.
5.5.2 The following warranty can be made applicable:
"It is a condition precedent to liability and it is warranted that the lightning conductors installed comply with the following requirements:
a) all lightning conductors and surge arrestors installed must comply with and be installed in accordance with SANS 10313 or SABS requirements;
b) equipment must be SABS-certified;
c) regular tests must be conducted and recorded and made available to the Company on request;
d) ensure compliance with manufacturer's specifications;
e) maintained on a regular basis."
5.6 Storage and handling of flammable liquids and dangerous goods
5.6.1 This is usually a declined risk, but can be accommodated where gas forms part of the business activity.
5.6.2 This must not be seen as an opportunity to enter a market where flammable liquids and gas are dealt with on a large scale.
5.6.3 This industry is heavily regulated and requires a high level skill (legislation) and knowledge.
5.6.4 The liability aspect arising from fire is huge and must be avoided at all cost.
5.6.5 For the smaller accommodation-type risk the following warranty should apply:
"It is a condition precedent to liability and it is warranted that the storage, transportation and handling of flammable liquids and/or dangerous goods comply with the following requirements and conditions:
a) the requirements of The Occupational Health and Safety Act: Regulation 4 including any subsequent amendments thereto;
b) the relevant South African National Standards Code of Practices, Specifications and or Standards for the storage, transportation and handling of any flammable liquids and/or dangerous goods;
c) the Regulations or ordinances and any amendments thereto of any provincial government or local authority or authority empowered to do so."
