Cladding
ban comes
into force
THE NSW BUILDING industry is on notice with the introduction of combustible cladding bans which officially come into force last month.
Corporations will be fined up to $1.1 mil- lion and individuals up to $220,000 for using any cladding with a core comprised of more than 30% polyethylene.
The state-wide prohibition affects any form of the combustible building material used in exter- nal cladding, external walls, external insulation, facades or rendered finishes for certain multi- storey residential and commercial premises.
The ban is retrospective and applies to buildings built before the ban came into force as well as those currently under con- struction or any future development.
Building owners and strata bodies of af- fected buildings can now be issued rectifica- tion orders under the Building Products (Safety) Act requiring them to undertake re- mediation and removal work.
If rectification orders are not acted upon corporations and strata body directors can face 2 years imprisonment or a fine totalling $110,000 per day until the matter is addressed. Carroll & O’Dea Lawyers’ Ben Robertson said the clock is ticking for building owners and strata corporations to act and comply with the state-wide ban.
“It is clear that rectification orders will be issued for affected buildings obliging build- ing owners to take action now to avoid fines and prison penalties,” he said.
“It is very important that building owners seek legal advice as to their potential liability and how they can comply with these new measures.”
The ban was introduced in the wake of the deadly Grenfell Tower fire in London and the LacrosseBuildingfireinMelbourne. ✺

CONDAIR GROUP AG of Switzerland has announced its acquisition of Aireven Pty Ltd in Australia.
Effective from August 2018, the new company name is Condair Pty Ltd.
The acquisition of Aireven in Australia con- tinues the strategic integration of Condair into promising geographic markets such as the Asia Pacific region and strengthens its position in the global humidification and evaporative cool- ing business.
Condair has been represented in the Austral- ian market for more than 40 years and since 2001 through Aireven and its owner Kevin Cronin.
The company is well established in industrial and commercial humidification and in-duct evaporative cooling.
Kevin Cronin will continue as managing di- rector of the new entity.
“Condair is the world’s leading manufacturer and supplier of humidification and evaporative cooling equipment,” Cronin said.
“Aireven has played a large part in creating and growing this foothold, as the exclusive distributor in Australia for Condair humidification solutions.
