ESTATE PLANNING
During this difficult time, we will assist you in every aspect of closing your loved one’s affairs. For decades, our lawyers have been answering our clients’ elder law questions, calming their fears and giving them peace of mind.
WILLS AND TRUSTS, ESTATE AND TAX PLANNING
All your life, you have worked hard to
save for rainy days and retirement and to ensure your hard-earned savings will pass to your loved ones. The last thing you need now is to worry about estate taxes, having enough money left over to take care of your family when you are gone or whether the planning documents you executed properly reflect your wishes. You do not need to worry when you hire us. We can help.
ELDER LAW
Needing long-term nursing home or in- home care is a real possibility. How will you afford it? Will the cost of it destroy the nest egg you worked so hard to create? What
if you or your spouse suffers a serious illness? Who will make medical decisions for you or your spouse if you are too ill to do so?
Whether you are simply preparing for retirement or are retired already, we can assist you with your elder law needs. It
is never too early to plan for your future. These questions can be answered with the help of experienced legal counsel.
PROBATE
We have decades of experience guiding our clients through the probate process. The steps include:
• Filing the last will and testament with the Surrogate’s Court
• Valuing estate assets
• Notifying beneficiaries under the last
will
• Distributing assets
• Working with your accountant
regarding the preparation and filing of estate tax returns
If your loved one did not have a will,
our experienced lawyers can help
your family as well. In these cases, we petition Surrogate’s Court for letters of administration on behalf of the family. That step provides the authority to collect assets and distribute them in adherence with
the New York state laws of “intestacy” (not having a will).
MEDICAID PLANNING
As part of our elder law practice, we also offer comprehensive home care Medicaid and nursing home Medicaid advice.
Our attorneys and staff have extensive experience in offering Medicaid planning advice and preparing and filing Medicaid applications. We can guide you through the entire process, from helping you select the right home care provider or nursing home for your loved one, to assisting with admission, to explaining important terms like bed holds and discharges, to advising you on how to use Medicare or Medicaid to pay for the cost of Home Care services and/ or nursing homes.
