NPGA SUES DOE: FINAL RULE ON CONSUMER FURNACES
On October 13, 2023, NPGA joined the American Gas Associ- ation and American Public Gas Association, suing the Depart- ment of Energy over its Final Rule for Commercial Water Heat- ers in the District of Columbia Circuit Court of Appeals. With a recent release of the DOE Final Rule on Consumer Furnaces, our coalition has sued the Department of Energy again.
NPGA will seek to consolidate the two cases along with a third suit on DOE’s Interpretive Rule, in which DOE decided not to
have a separate product class for non-condensing appliances. All three of these suits focus on whether DOE should have estab- lished a separate product class for non-condensing appliances under the Energy Policy and Conservation Act. NPGA is con- sulting with outside counsel regularly to provide information and bolster arguments to protect consumer choice and preserve efficient appliances from government overreach and flawed reg- ulations.
DONATE TO THE OHIO PROPANE PAC
The OPGA is battling to maintain propane use throughout Ohio as well as other fights like the subsidized natural gas expansion and limited liability for propane providers. As you witnessed with the natural gas victory, we cannot fight these fights alone. Please make a donation to the Ohio Propane PAC today and encourage your employees to make donations as well. Our entire industry is being threatened, and we need our entire industry to help and contribute.
