Essential to Justice and Justice is Essential
This was a Colorado headline on 12/26/2020 – “Colorado courts facing unprecedented backlog now hobbled by COVID-
        19 budget cuts”.

Legal investigators are an integral – essential – component of our judicial system. Throughout 2020, and even now, we
continue to be considered ‘non-essential’ in many states – including Colorado. Even attorneys have been considered
non-essential. The Professional Private Investigators Association of Colorado (PPIAC) wrote the Department of
Regulatory Agencies (DORA) and modified this – but not wholly reversed. Courts have suspended hearings and trials, law
enforcement has stopped some enforcement or investigations – in Colorado traffic violations are blatantly turned from,
motor vehicle collisions not investigated, and arrests are only for felonies and maybe serious misdemeanors.

As defenders of our Constitution, and for persons exercising their rights as victims and defendants, not only are
professional investigators integral and essential – every right is. In 2020 we saw these rights ignored, trampled on, and
rewritten as a matter of public health and safety. It is essential we end this practice of violation by acceptance. Every
person and every right not pursued or defended is a tragedy of justice to victims and defendants.

The ability for victims and defendants in civil and criminal cases to seek justice has been stifled - from the lack of official
investigations to the right to adjudication. As legal investigators, and our attorney-clients, these are also the very tools
needed to investigate and advocate fully, competently, and effectively. Lack of enforcement and investigation also
creates a lack of reasonable suspicion, probable cause or even a preponderance. We truly cannot let what happened in
2020 continue or happen again. We must immediately end these violations and acceptance, or 2021 will be chilling.
