Our environmental lawyers regularly conduct due diligence on environmental issues involved in the purchase, sale, leasing and financing of real property and structure environmental disclosures to make sure our clients’ transactions succeed. We also advise on the environmental requirements involved with constructing, operating and closing real property facilities and work cooperatively with agencies to obtain environmental permits and approvals. We can advise Vantage on environmental cleanup and remediation issues involved with buying, selling and managing contaminated property and facilities. Government Approvals
Local permitting can be delayed for months or years by rezoning, appeals from neighbors or other interested parties, disputes between the developer and the jurisdiction, and an involved design process that requires multiple site plan iterations. For this reason, permitting is often the greatest hurdle to project financing. There are usually two distinct approvals required to begin construction: land use approval and building approval. A land use permit is a governing jurisdiction’s approval of the project on a conceptual level. Almost every jurisdiction in the country has some form of land use regulation, which provides a subjective system of sorting and qualifying not only the proposed use of land (retail, industrial, residential, etc.) but also the physical characteristics of the improvements (height, density, setbacks, etc.).
