ORDINANCE NO. 2019-02 SUMMARY
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DINUBA ESTABLISHING REGULATIONS AND STANDARDS PERTAINING TO STREET VENDORS AND PROVIDING FOR THE ENACTMENT AND EFFECTIVE DATE THEREOF
THE CITY COUNCIL OF THE CITY OF DINUBA HEREBY DOES
ORDAIN: SECTION 1. FINDINGS.
(a) The State of California has adopted SB 946 that requires local agencies to allow sidewalk vendors, subject to regulations.
(b) Sidewalk vending, because it has a relatively low barrier to entry, encourages entrepreneurship.
(c) Providing economic opportunity for people to support themselves and their families is one of the most important goals for the City.
(d) The Dinuba City Council nds that there is a need to regulate the sale of food and merchandise in the public right of way.
(e) Regulations are needed to ensure that the public has a simple way to ensure vendors prepare food safety and according to the Fresno County Department of Public Health’s requirements.
(f) Regulations are needed to prevent unsanitary conditions and en- sure trash and debris are removed by vendors.
(g) Regulations are needed to accommodate a vendor’s equipment while safe-guarding pedestrian movement on the sidewalk.
(h) The City Council nds that regulation of sidewalk vending bene ts the City as a whole as it leads to orderly commerce.
SECTION 2. Amendments were made to Title 5 (Business Licenses and Regulations).
SECTION 3. SEVERABILITY.
Each of the provisions of this ordinance is severable from all other provisions. If any article, section, subsection, paragraph, sentence, clause or phrase of this ordinance is for any reason
held by a court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remaining portions of this ordinance. SECTION 4. This Ordinance shall take effect and be in full force thirty (30) days from and after its adoption.
SECTION 5. The foregoing Ordinance No. 2019-02 introduced at a regular meeting of the City Council of the City of Dinuba on the 11th day of June, 2019, by the following vote:

ORDINANCE 2019-03
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DINUBA AMENDING THE DINUBA MUNICIPAL CODE TITLE 14, CHAPTER 14.62 BY AMENDING SECTION 14.62.050 REGARDING THE HISTORIC PRESERVATION COMMISSION AND PROVID- ING FOR THE ENACTMENT, PUBLICATION AND EFFECTIVE DATE THEREOF
NOW THEREFORE, the City Council of the City of Dinuba does ordain as follows:
Section I: Title 14, Chapter 14.62 is hereby amended by amending Section 14.62.050 and as amended, shall read as follows:
Section 14.62.050 Historic Preservation Commission.
A. Composition: The Commission shall consist of ve (5) persons having a demon- strated interest, competence or knowledge in historic preservation and, unless otherwise speci ed. At least two (2) commission members shall be appointed from among profession- als in the disciplines of architecture, history, architectural history, planning, pre-historic and historic archeology, folklore, cultural archaeology, curation, conservation, landscape architec- ture or related disciplines such as urban planning, American studies, American civilization or cultural geography, to the extent that such professionals are available in the community and are willing to serve on the Commission. Commission members may also include lay persons who have demonstrated special interest, competence, experience or knowledge in historic preservation.
B. Operation: There is, hereby created, an Historic Preservation Commission which shall review the historic value of buildings, objects, and districts and report to the City Coun- cil when prescribed in this chapter. The Historic Preservation Commission shall consist of ve (5) members: two (2) members of the Alta District Historical Society, two (2) members appointed at-large from within the city limits, and (1) Planning Director or designee. Appoint- ments shall be for three year terms.
C. An architect, land use planner, or historian may also be included as a non-voting member of the commission. This professional shall serve in an advisory capacity. Should the Commission be considered a potential historic resource in which one or more of the voting members of the Commission has a vested interest, the Commission shall seek the advice of a disinterested person.
Section II: The City Clerk is hereby directed to cause a summary of this Ordinance to be published by one insertion in a newspaper of general circulation in the community at least ve (5) days prior to adoption and again fteen (15) days after its adoption. If a summary of the ordinance is published, then the City Clerk shall cause a certi ed copy of the full text of the proposed ordinance to be posted in the of ce of the City Clerk at least ve days prior to the Council meeting at which the ordinance is adopted and again after the meeting at which the ordinance is adopted. The summary shall be approved by the City Attorney.
This Ordinance shall take effect and be in full force thirty (30) days from and after its adoption. The foregoing Ordinance 2019-03 introduced at a regular meeting of the City Council of the City of Dinuba on the 11 day of June, 2019, and adopted and approved by the City Council of the City of Dinuba on this 25 day of June, 2019, by the following vote:
