Owner reserves the right to approve or reject the surety insurers selected by the successful bidder and to require the successful bidder to obtain bonds from surety insurers satisfactory to the Owner. The bidder will be required to furnish insurance as set forth in the Contract Documents. The successful bidder will be allowed to substitute securi- ties or establish an escrow in lieu of retainage, pursuant to Public Contract Code Section 22300, and as described in the Agreement Between Owner and Contractor and Gen- eral Conditions.
The Owner will not consider or accept any bids from con- tractors who are not licensed to do business in the State of California, in accordance with the California Public Contract Code, providing for the licensing of contractors. In accordance with Section 3300 of said Code, the bid- der shall have a Class “C-39” license and shall maintain that license in good standing through Project completion and all applicable warranty periods. Bidder shall state the California contractor license number on the Designation of Subcontractors form for all subcontractors doing more than one-half of one percent (0.5%) of the bidder’s total bid. An inadvertent error in listing a California contrac- tor’s license number shall not be grounds for ling a bid protest or for considering the bid nonresponsive if the bid- der submits the corrected contractor’s license number to the Owner within 24 hours after the bid opening, or any continuation thereof, so long as the corrected contractor’s license number corresponds to the submitted name and location for that subcontractor.
Subcontractors shall maintain their licenses in good stand- ing through Project completion and all applicable warranty periods. Owner reserves the right to reject any bid as non- responsive if bidder or any subcontractor is not licensed in good standing from the time the bid is submitted to Owner up to award of the Contract, whether or not the bidder listed the subcontractor inadvertently, or if a listed subcon- tractor’s license is suspended or expires prior to award of the Contract. Owner also reserves the right to reject any bid as non-responsive if a listed subcontractor’s license is not in good standing to perform the work for which it is listed from the time of submission of the bidder’s bid to award of the Contract.
The Owner reserves the right to waive any irregularity and to reject any or all bids. Unless otherwise required by law, no bidder may withdraw its bid for a period of sixty (60) days after the date set for the opening thereof or any authorized postponement thereof. The Owner reserves the right to take more than sixty (60) days to make a deci- sion regarding the rejection of bids or the award of the Contract.

MANDATORY PRE-BID CONFERENCE AND SITE VIS- IT: The pre-bid conference and site visits will be at Citrus Middle School, 1400 Anchor Avenue, Orange Cove, CA 93654 and beginning at 10:00 am on February 16, 2018. Attendance is mandatory, bidders not attending the con- ferences will be disquali ed from bidding on any section. NOTICE TO CONTRACTORS
Notice is hereby given that Kings Canyon Uni ed School District (hereinafter referred to as “Owner”) has issued notice to contractors calling for Prequali cation Applica- tions for General Contractors. Those Contractors who have been Prequali ed will receive a copy of Request for Proposal (RFP)for Lease-Lease Back Services for each project and will be eligible to submit a proposal for each Lease-Lease Back Project. The District intends to award separate contracts for each project to the contractor deter- mined to be the best value under the provisions of Educa- tion Code 17406 et seq.
Those contractors who’s Prequali cation expires during any release of RFP will not be able to submit a proposal. Contractor must be prequali ed as of the date the respec- tive proposal is due.
California Assembly Bill (AB) 1565 went into effect on Jan- uary 1, 2014. AB 1565 requires ALL General Contractors and M/E/P Subcontractors be prequali ed, if the contract is valued at $1 million or more and funded whole or in part with State Facility Bond funds. This applies to the follow- ing license numbers:
•General Contractors (A and B)
•Mechanical, Engineering, and Plumbing subcontractors (“MEPs”): C-4, C-7, C-10, C-16, C-20, C-34, C-36, C-38, C-42, C-43, and C-46

If a contractor has not already been prequali ed by the Owner, Owner will not accept the contractor’s proposal. Each prequali ed contractor who intends to submit a proposal must also submit the Prequali cation Certi ca- tion as part of the sealed proposal certifying under oath that the contractor’s responses in its initial prequali ca- tion submission continue to be true and correct.
