TAKE NOTICE that at its Regular Meeting of April 13, 2021 at 6:30 pm
in the Council Chambers of the City of Dinuba City Hall, 405 E El Monte Way, California, the Dinuba City Council considered and adopted urgency Ordinance No. 2021-01 entitled:
AN URGENCY ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DINUBA ENACTING A TEMPORARY MORATORIUM ON THE ESTAB- LISHMENT OF MASSAGE BUSINESSES
The Dinuba Municipal Code (Section 17.02.030) currently allows “Mas- sage therapy business/physical culture studios” as a permitted use, subject to a Conditional Use Permit in the PO (Professional Office), C-2 (Downtown Commercial) and C-4 (General Commercial) zones.
The ordinance prohibits the establishment of “Massage therapy business/ physical culture studios” for a period of 45 (forty five) days. Consistent with California Government Code Section 65858 (a) the moratorium may be extended for 10 months and 15 days and subsequently extended for one year.
During the moratorium it is the City’s intent to prepare and adopt a com- prehensive ordinance that permits and regulates massage businesses in a manner that protects the public health, safety and welfare.
The urgency ordinance shall take effect immediately as an urgency ordinance necessary for the immediate preservation of the public peace, health or safety, pursuant to California Government Code section 36937(b). The ordinance is consistent with Dinuba City Charter Section 2.13. Emergency Ordinances.
Urgency Ordinance No. 2021-01 was adopted unanimously by the follow- ing vote:

No contract will be awarded to a Contractor who has not been licensed in accordance with the provisions in Chapter 791, Statutes of 1919, as amended, or whose bid is not on the proposal form included in the contract documents. A valid California Contractor’s License is required for this project. The City of Orange Cove hereby notifies all bidders that it will affirmatively ensure that in any contract entered into pursuant to this advertisement, Disadvantaged Business Enterprise (DBE), Minority Business Enterprise, and Women-Owned Business Enterprise will be afforded full opportunity to submit bids in response to this invitation and will not be discriminated against on the grounds of race, color, religious creed, sex, or national origin in consideration for an award.
