CITY OF SANGER ORDINANCE NO. 2020-05
On June 4, 2020, the Sanger City Council approved the following Ordinance.
URGENCY ORDINANCE NO. 2020-05 OF THE CITY COUNCIL OF THE CITY OF SANGER AUTHORIZING TEMPORARY MODIFICATION OF THE ZONING ORDINANCE, MOBILE FOOD VENDING, AND OTHER REGULATIONS TO ALLOW LOCAL BUSINESSES TO UTI- LIZE STATE COVID-19 TEMPORARY CATERING AUTHORIZATIONS
The ordinance provides temporary modi cation to allow existing businesses use of State of California COVID-19 Temporary Catering Authorizations.
Notwithstanding any Sanger City Code requirements and provision or entitlement condition(s) of approval regulating the use of property within the City of Sanger will consider issuing a Director’s Approval to existing businesses which meet the terms and conditions of the ABC COVID-19 Temporary Catering Authorizations and the conditions in this ordinance. This will allow existing businesses in the City with an on-sale ABC license for dining establishments to serve alcoholic beverages during times in which meals are being served in an expanded area as de ned by the ABC (including private parking lots). Such businesses must secure a temporary permit in the form of a Director’s Approval from the City to begin such operation as described in Section 3E of this ordinance and is subject to the following requirements:
A. Compliance with ABC requirements. The business must at all times meet all of the follow- ing requirements:
(i) possess a license issued by the ABC;
(ii) have a valid “COVID-19 Temporary Catering Authorization” issued by the ABC;
and
(iii) be in compliance with all ABC license, ABC Authorization, or other requirements. Said licensing must be posted and promptly provided to any City of cial on request.
B. Food Vending: If otherwise approved by the ABC, a non-retail licensee (for ABC licensed on-sale dining establishments) that does not operate a bona  de eating place may enter into a written contract with a food vending service, including a mobile food vending service with kitchen facilities, to be a meal provider for the non-retail licensee. In such cases, the following will apply:
There must be a written agreement in writing between the non-retail licensee and the food vendor to provide meal services, which shall be promptly provided to City of cials upon re- quest.
All orders for food shall be taken directly from patrons by the non-retail licensee, and the food vendor shall not serve or take orders directly from customers or the public. When operating under a written contract with the non-retail licensee, mobile food vendors shall prominently display a sign reading “Closed” or “Closed to the General Public,” and may include additional signage with directions as to how food may be ordered through the non-retail licensee, such as “Orders may be made through [non-retail licensee].”
A mobile food vendor as de ned by Sanger City Code section 70-64(i) may be located on- site or parked on a street within 150 feet of the non-retail license location where parking is otherwise permitted.
No more than one mobile food vendor shall provide services to the non-retail licensee at any one time under this Urgency Ordinance.
All food vendor(s) must have a City of Sanger business license and permitted under the Sanger City Code.
Food vendors shall not create a nuisance.
(a) No portable generators shall be operated by a mobile food vendor within 250 feet of a
residence, unless said residence is located on the property of the non-retail licensee. Mobile food vendors may temporarily use electrical connections from the non-retail licensee property as long as said connections are compliant with Sanger City Code requirements and do not create a public safety hazard.
(b) Operations shall not obstruct sidewalks or other public thoroughfares.
(c) Lighting shall not be directed toward adjacent properties or otherwise create a glare.
(d) No music shall be broadcast by a food vendor when providing services to the non-retail licensee if located within 250 of a residence not otherwise associated with the non-retail li- censee.
C. Operations in the Expanded Area.
(i) Temporary tables, chairs, shade equipment (such as umbrellas), and temporary lighting are permitted in the expanded area. Such items may not be located in the public right-of-way, such as sidewalks and other public thoroughfares, and shall not be located in a driveway or other vehicle entrance way. Lighting shall not be directed toward adjacent properties or otherwise create a glare toward adjacent properties. No generators shall be used to provide service to any expanded area.
(ii) The expanded area may be located outside or on or in any structure that is in compliance with the City’s Building Code and has been constructed with required permits. No new struc- tures may be erected on the property without  rst obtaining a permit from the City.
(iii) If the expanded area is located in a parking lot or would otherwise affect traf c, the non- retail licensee shall prepare a “Temporary Traf c Operations Diagram” prior to beginning oper- ations. The Temporary Traf c Operations Diagram shall contain a diagram outlining the loca- tions of operations (including the proposed dining area), depict traf c circulation, and identify parking on-site to ensure that operations shall not i) block disabled parking; ii) inhibit access to the business (including ADA, police, and  re access); iii) encroach into the public right-of-way; iv) create potentially harmful interactions between vehicles and pedestrians or persons who
are dining as well as deliveries of food from the mobile food vendor to the non-retail licensee; v) meet the minimum number of parking spaces; or vi) cause traf c to que onto the roadway. The Temporary Traf c Operations Plan must be posted and promptly made available to any person on request. Any City code enforcement or law enforcement may immediately require operations in the expanded area under this ordinance to cease until a Temporary Traf c Op- erations Diagram is provided that meets the requirements of this subsection.
(iv) Street parking by patrons is prohibited in a residential area. If the non-retail licensee’s operation is within 250 feet from a residence, then the expanded area in which meals are be- ing served cannot be more than 30% of the on-site parking area. If there are no residences within 250 feet of operations, then the expanded area in which meals are being served can- not exceed 60% of the on-site parking area. All measurements shall be from property line to property line.
(v) Outdoor music, live bands, or similar entertainment is not authorized by this Urgency Or- dinance.
D. No Vested or Other Rights Created. Nothing in this Urgency Ordinance shall create a vested right or other right to continue to operate consistent with this Urgency Ordinance, and any person operating under this Urgency Ordinance expressly recognizes that it may be ren- dered of no further force or affect at any time.
E. Director’s Approval - Temporary Permit Process. Prior to commencing operation under this Urgency Ordinance, the non-retail licensee must obtain a temporary permit from the City’s De- velopment Services Director. Upon receiving a completed application, the Development Ser- vices Director may promptly issue a temporary permit, with conditions of approval, based upon  ndings that the proposed used complies with the requirements of this Urgency Ordinance and that the proposed use will not be detrimental to public health, safety, or welfare. Notice of the same shall be provided to the non-retail licensee and all property owners pursuant to Sanger Code Section 90-1018(3). The appeal process set forth in Sanger Code Section 90- 1019 shall be applicable, except that the applicant may elect to proceed at its own risk within three business days of the issuance of the Director’s Approval. If an appeal is timely received by the City, the applicant must cease operations under the temporary permit within  ve busi- ness days after being informed by the City thereof until the matter has been considered by the Planning Commission per Sanger Code Section 90-1019. The Director is authorized to develop guidelines for applications in accordance with this Urgency Ordinance.
Nothing in this Urgency Ordinance shall relieve any person from compliance with other State and local regulations, including i) State Executive Orders, such as those related social distanc- ing guidelines, limitations on group gatherings, etc.; ii) County (when jurisdiction is present) and City orders, including those issued in response of a local emergency; iii) compliance with the Sanger City Code, including Section 38-7.2 (nuisances, including excessive noise) and Chapter 90 (zoning ordinance, including requirements related to structures, setbacks, etc.); iv) or conditions of approval for an entitlement associated with use of the property, including hours of operations, security requirements, etc., but not those conditions that would otherwise prevent use of the ABC Application in the expanded area.
APPLICABLE PERIOD/SUNSET PROVISIONS. This Ordinance is effective as of 12:00 a.m. on June 5, 2020, and shall remain in effect until any of the following occur: (i) revocation or similar other action by the Council to render this ordinance of no further force or effect; (ii) the termination of the local declaration of emergency by the City Council; (iii) the cancellation of the COVID-19 Temporary Catering Authorization program by ABC; (iv) the termination of the State declaration of emergency related to COVID-19; or (v) the City’s revocation for failure to meet the requirements of this ordinance.
In summary, the City Council  nds that there is a current and immediate threat to public health, safety, and welfare posed by COVID-19, and there is an immediate need for the preservation of public peace, health or safety of the residents and community of the City. One of the many effects of the COVID-19 pandemic is that the stay at home order precludes many businesses from operating, and also precludes many residents of the City from working, or signi cantly reduces the hours that may be worked, or requires residents to refrain from working or to work fewer hours, as certain businesses cannot operate out of doors or at reduced capacity to encourage social distancing. The City Council further  nds that during this local emergency, and in the interest of protecting the public health and preventing transmission of COVID-19, it is essential to ensure that residents can work at places of employment in a safe manner, and businesses to continue to provide services to the community.

Minimum wage rates for this project, as predetermined by the U.S. Department of Labor, are set forth in the Special Provisions.
