ORDINANCE 2019-04
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DINUBA AMENDING THE DINUBA MUNICIPAL CODE TITLE 2, CHAPTER 2.36 BY AMENDING SECTION 2.36.020 AND 2.36.030 REGARDING THE PUBLIC SAFETY COMMISSION AND PRO- VIDING FOR THE ENACTMENT, PUBLICATION AND EFFECTIVE DATE THEREOF
NOW THEREFORE, the City Council of the City of Dinuba does or-
dain as follows:
Section I:Title 2, Chapter 2.36 is hereby amended by amending Sec- tion 2.36.020 and as amended, shall read as follows:
Section 2.36.020 Appointment and Quali cations.
The public safety commission shall have  ve members appointed in accordance with the provisions of this chapter. All  ve members shall be appointed at large. Members at large shall be appointed from within the Dinuba City Limit boundaries as currently set or as subse- quently amended. If any appointed at large member of the commis- sion subsequently changes permanent residence to a place outside the city limit boundaries, said position shall become automatically vacant and shall be  lled as any other vacancy. No person who is an immediate family member of a city council member, city of cial, city employee, or a member of the Dinuba Citizens’ voluntary patrol can serve as a commission member. For the purposes of this chapter, an “immediate family member” shall be de ned as a relative within the second degree.
Section 2.36.030 Vacancies.
Vacancies shall be  lled by the appointment process set forth by city policy concerning appointment to commissions and committees. Section II: The City Clerk is hereby directed to cause a summary of this Ordinance to be published by one insertion in a newspaper of general circulation in the community at least  ve (5) days prior to adoption and again  fteen (15) days after its adoption. If a summary of the ordinance is published, then the City Clerk shall cause a certi ed copy of the full text of the proposed ordinance to be posted in the of ce of the City Clerk at least  ve days prior to the Council meeting at which the ordinance is adopted and again after the meeting at which the ordinance is adopted. The summary shall be approved by the City Attorney.
This Ordinance shall take effect and be in full force thirty (30) days from and after its adoption.
The foregoing Ordinance 2019-04 introduced at a regular meeting of the City Council of the City of Dinuba on the 13th day of August, 2019, and adopted and approved by the City Council of the City of Dinuba on this 27th day of August, 2019 by the following vote: AYES: COUNCIL MEMBERS: Launer, Thusu, Longoria, Morales NOES: COUNCIL MEMBERS: None

NOTICE TO BIDDERS
Notice is hereby given that sealed bids will be received by the City Council of the City of Reedley for furnishing all labor, materials, services, and equipment and perform- ing all work necessary for the ROYAL VALLEY PARKING LOT in the City of Reedley, Fresno County.
Project plans, special provisions, bid and contract doc- uments are on  le and may be examined at the City’s website www.reedley.ca.gov and at the Of ce of the City Engineer, 1733 Ninth Street, Reedley, California, 93654, (559) 637-4200, ext. 295. Copies may also be examined at the following Builders Exchanges:
•Central California Builders Exchange •Tulare-Kings Builders Exchange •McGraw-Hill Construction Dodge •Construction Bid Board
Construction Bid Copies may be obtained at the City of Reedley for a charge of TWENTY dollars ($20.00) per set, nonrefundable. In addition, there will be an eight dollars ($8.00) mailing and handling charge for any sets mailed. Prospective bidders must be on the plan holders list in order to submit a bid proposal and to receive any addendums issued by the City of Reedley.
Description of Work: The work includes, in general, Base Bid – installation of chain and bollards, fence, historic lights, conduit installation, concrete valley gutter, drain- age inlet, 12-inch RCP storm drain, and striping. Alter- native A - includes hot mix asphalt concrete, aggregate base, and roadway excavation. Alternative B – includes portland cement concrete, welded wire mesh, and road- way excavation.
This work shall be diligently prosecuted to completion before the expiration of THIRTY (30) WORKING DAYS beginning on the tenth calendar day after approval of the contract.
The City of Reedley hereby noti es all bidders that it will af rmatively insure that in any contract entered into pur- suant to this advertisement, minority business enterprises will be afforded full opportunity to submit bids in response to this invitation and will not be discriminated against on the grounds of race, color, religious creed, sex, or nation- al origin in consideration for an award.
The prevailing wage rates as determined by the Direc- tor of Industrial Relations of the State of California shall apply to this project. In accordance with the provisions of Section 1770 of the Labor Code, the Director of the Department of Industrial Relations of the State of Califor- nia has determined the general prevailing rates of wages and employer payments for health and welfare, pension, vacation, travel time, and subsistence pay as provided for Section 1773.8 of the California Labor Code, appren- ticeship or other training programs authorized by Section 3093 of said code, and similar purposes applicable to the work to be done. Said wages are on  le with the City of Reedley and County of Fresno and are incorporated herein as part of the special provisions. By submission of a bid, bidder stipulates and agrees to abide by the provi- sions of the Labor Code related to payment of prevailing wage or promptly pay a penalty of $50.00 per day per worker paid less than prevailing wage pursuant to the provisions of Labor Code Section 1775. A work day shall not exceed eight hours labor per day or forty (40) hours labor per week. The successful bidder shall keep an ac- curate record of employees’ hours worked by calendar day and week.
Minimum wage rates for this project, as predetermined by the Secretary of Labor, are set forth herein in the bid and contract documents and incorporated as part of the special provisions. These wage rates may be examined at the City of Reedley where the project plans, special
provisions, bid and contract documents may be seen. If there is a difference between the minimum wage rates predetermined by the Secretary of Labor and the prevail- ing wage rates determined by the Director of the Depart- ment of Industrial Relations of the State of California for similar classi cations of labor, the Contractor and his sub- contractors shall pay not less than the higher wage rate. Bids must be  led with the Reedley City Engineer, 1733 Ninth Street, Reedley, not later than 3:00 p.m., Thursday, September 19, 2019, at which time the Of ce of the City Engineer of the City of Reedley will open said bids. Bids must be submitted in a sealed envelope and marked on the outside of the envelope “ROYAL VALLEY PARKING LOT” together with the name and address of the bidder. The bids will be opened and read publicly at that time.
Each bid must be accompanied by either a cashier’s check, certi ed check or bidder’s bond in a sum equal to at least ten (10%) percent of the total amount bid. Checks or bonds must be made payable to the City of Reedley; such securities shall be a guarantee that the bidder, if his bid is accepted, will enter into a satisfac- tory contract and furnish a good and suf cient bond for faithful performance thereof and for payment of labor and material costs in accordance with the requirements of the plans and speci cations.
No contract will be awarded to a Contractor who has not been licensed in accordance with the provisions of Chap- ter 791, Statutes of 1929, as amended, or whose bid is not on the proposal form included in the contract docu- ments. An appropriate and valid California Contractor’s License is required for the project. Class A General Engi- neering Contractors license is required.
No contractor or subcontractor may be listed on a bid proposal for a public works project (submitted on or af- ter March 1, 2015) unless registered with the Department of Industrial Relations pursuant to Labor Code section 1725.5 [with limited exceptions from this requirement for bid purposes only under Labor Code section 1771.1(a)]. No Contractor or subcontractor may be awarded a con- tract for public work on a public works project (awarded on or after April 1, 2015) unless registered with the De- partment of Industrial Relations pursuant to Labor Code section 1725.5.
This project is subject to compliance monitoring and en- forcement by the Department of Industrial Relations. Interpretations: Al questions about the meaning or intent of the Contract Documents shall be directed to the of ce of the City Engineer in writing. Interpretations or clari-  cations considered necessary by the City Engineer in response to such questions will be resolved by the issu- ance of addenda delivered to all parties listed on the plan holders list. Questions received less than 3 business days prior to the date of opening bids shall be considered nonresponsive and therefore not addressed. Only ques- tions that have been resolved by formal written addenda shall be binding. Oral and other interpretations or clari - cations will be without legal or contractual effect.
The City reserves the right to reject any or all bids, to waive any informality in bids received, or to award the contract to the lowest responsible bidder complying with these instructions as may serve the best interest of the City of Reedley. The City reserves the right to award the contract to other than the lowest bidder if it appears that the best interests of the City of Reedley will be served thereby.
