CITY OF SANGER NOTICE OF PUBLIC HEARING
NOTICE IS HEREBY GIVEN that the Planning Commission of the City of Sanger (“City”) will hold a public hearing at its meeting on April 22, 2021, at 6:00 pm, or as soon thereafter as possible, to consider the following items:
Proposed Addition of New Zone Districts C-5 and RMU (Zoning Amendment No. 2021–01): The Planning Commission will consider a Resolution of the Planning Commission Recommending the City Council 1) Adopt Zoning Amendment No. 2021-01 to Add the C–5 (Highway Commercial) Zone District and the RMU (Retail–Mixed Use) Zone District to the Sanger Municipal Code including by Amending Section 90-91 in Article II of Chapter 90, and by Add- ing Articles XXVIII and XXIX to Chapter 90 of the Sanger Municipal Code; and 2) Adopt an Exemption per CEQA Guidelines Section 15063(b)(3).
• Project Location: The amendment of the zoning ordinance would apply City-wide.
• Project Description: The City recently adopted the 2035 General Plan update, including the North Academy Corridor Master Plan as an imple- menting tool. As part of this update, the 2035 General Plan called for the creation of two new zoned districts, C-5 (Highway Commercial District) and RMU (Retail Mixed-Use District). Zoning Amendment No. 2021-01 implements the General Plan update by amending the Sanger Municipal Code
to integrate the C-5 and RMU zoned districts. Given the “project” under the California Environmental Quality Act (CEQA) implements the previ- ously approved and assessed 2035 General Plan update, the project is exempt from further environmental review under CEQA Guidelines Section 15063(b)(3).
Proposed Annexation of the North Academy Corridor Master Plan Area (Zoning Amendment No. 2021-02/Annexation): The Planning Commis- sion will also consider the following:
• A Resolution of the Planning Commission Recommending the City Council i) Adopt a Finding of Consistency with the 2035 General Plan and Envi- ronmental Impact Report (EIR); and ii) Adopt Pre-Annexation zoning for the North Academy Corridor Master Plan Area for Approximately 285 Acres of Land Generally Centered Along Academy Avenue from the Northern City limits to State Highway 180.
• A Resolution of the Planning Commission Recommending the City Council Initiate Annexation for the North Academy Corridor Master Plan Area.
Project Location: The pre-annexation zoning and annexation would apply to the North Academy Corridor Master Plan Area generally centered along Academy Avenue from the northern City limits to State Highway 180. (See diagram, below.)
Project Description: Last year the City adopted the 2035 General Plan update, including the North Academy Corridor Master Plan as an implementing tool, and certified an Environmental Impact Report (EIR) for the update. The North Academy Corridor Master Plan area is currently within the jurisdiction of the County of Fresno, but is within the City of Sanger’s Sphere of Influence. Fresno County has zoned most of the Master Plan area for Agriculture (AE-20), with General Commercial (C-6) designations at the southwest and southeast corner of the intersection of Highway 180 and Academy Avenue. The Master Plan area is proposed to be annexed into the City limits of Sanger and thus the Master Plan area is proposed be pre-zoned to match the pro- posed land use designations of the 2035 General Plan. The Master Plan designates the area with the following proposed pre-zoning designations: i) ap- proximately 98 acres to General Commercial (C-4); ii) Approximately 43 acres to Highway Commercial (C-5); and approximately 91 acres to Retail Mixed Use (RMU). Land is also designated for proposed pre-zoning to Public Facilities (RSC), approximately 29.29 acres. Zoning Amendment No. 2021-02 would adopt pre-annexation zoning for the Master Plan area as further depicted in the diagram for equivalent land use types. The Planning Commission will also be considering a recommendation to the City Council to initiate annexation of the Master Plan area to annex the area into the City’s limits.
The City of Sanger has conducted an environmental analysis of the project and has been determined to be a project that is consistent with the 2035 General Plan and Environmental Impact Report (EIR) (SCH #2018031047) certified by the City for the General Plan. Therefore, a Finding of Consistency
is proposed for this project.
Annexation Area and Proposed Zoning:
General: All interested parties are invited to submit statements orally or in writing. Written comments must be delivered to the Planning Commission Secretary, prior to the scheduled hearing date. The meeting at which the public hearing will be held will be conducted pursuant to the provisions of Paragraph 11 of the Governor’s Executive Order N-25-20 which suspends certain requirements of the Ralph M. Brown Act, and as a response to mitigating the spread of COVID-19, the meeting will be held via teleconference and will not be physically open to the public.
