EXTRACTED STATEMENT FROM MIRA MAKAR, MA, FCA
Testified on April 16, 2018 before the I.T.N.J. regarding
money flow aspects of transactions involving human trafficking
MIRA MAKAR has operated in the rescue market since 1982, mainly as principal; with customer sites in Europe, Crown Dependencies, and Hong Kong. A witness to the Companies Investigation Branch of the DTI since 2005,
Mira has sector specialization in leading teams delivering operating systems in trust and fiduciary, and private banking.
“My testimony highlighted the money flow aspects of transactions involving human trafficking as evidenced before the Commission, as well as evidencing the laundering of such proceeds.
I drew parallels with mature cross border markets for financial instruments, including those for risk shift, conversion, elimination; tax evasion product; as well as the rental on commission of professional firms’ infrastructures, operating as transaction facilitators in more complex Ponzi schemes.
I testified about highlighting common laundering apparatus, such as bankruptcy courts, operating devices such as ‘branding;’ state registers; property markets; organs of state; as well as wealth managers including fiduciary.
My testimony was set out in five sections. These covered:
(i) money laundering of financial fraud instruments as relied upon and used in human trafficking (the ‘apparatus’ or ‘machinery’);
(ii) demonstrating that articles used in financial fraud in developed markets have a comparable
in human trafficking by dint of putting an explicit or implicit price on human life (to trade or buy out of bondage) and/or components of deception (e.g. enticing a person to move in the hope of escape and/or improved prospects);
(iii) identifying use of ‘professional’ firms as
fronts. These are facilitators of anonymity.
They are rentiers of infrastructures with
a plethora of devices in their tool-kit or armoury, including to facilitate obstruction and prolonged alienation with a view to disabling and weakening, including by driving wedges between key relationships of trust.
These devices include putting a price on a Target’s head, with transaction commission ‘paid for’ out of dissolved Target’s estate/ standing. The integrity of the whole is a form of hermetic seal. It includes the right to assert oneself, including image. Once broken, it cannot be put together again with glue or otherwise. It is comparable to judicial review after the event which gives a favourable outcome but after the irreparable damage is done (e.g. closing day centre for the elderly or citizens advice). Human rights evaporate on death.
A contaminated law enforcement system is one which is permissive of perversity without automatic contempt and curtailment. It will reference ‘balancing rights’ rather than recognizing that each human right is absolute and co-exists with each of the other rights severally. The sanctity of human life operated in the judicial system is undermined when
