Deposition Drills How to Teach Deposition Skills
  Recreating a Scene
Sometimes you need a witness to recreate a scene. Who was involved? Where was everyone? What was everyone doing? What was the lighting? What were the distractions? What were the relevant distances? Speeds? This information is relevant and necessary for experts and for your case presentation. Teaching your team to look at scenes critically will help them ask better and more thorough questions of witnesses.
EXPLANATION
Participants will learn how to recreate a scene when questioning a deponent.
EXERCISE
Think about a scene from one of your cases. Generally describe it to the participants and have them question you about it. Provide them cues and prompts on how to narrow in on issues and focus on various aspects of the scene.
LESSONS LEARNED
This exercise teaches participants to focus on often overlooked details to recreate a scene with a deponent’s words.
