Deposition Drills How to Teach Deposition Skills
  Exhaust Witness’s Knowledge
Similar to exhausting each topic, exhausting a witness’s knowledge is important to learn everything a witness knows about the case. This exercise addresses how to exhaust a witness’s knowledge.
EXPLANATION
Participants learn to secure all the information a witness has about a topic.
EXERCISE
Identify a witness you cross-examined in deposition and describe the case and the role of the witness in the case to the participants. Have the participants question you (as you role play the witness) and have them take turns until they’ve exhausted your knowledge on a topic or issue.
LESSONS LEARNED
Exploring the depths of a witness’s knowledge is crucial to ensure you secure all relevant information and avoid surprise later. It takes persistence and a touch of creativity to cover the waterfront.
