Citation infractions are sent to a local district court for issuance to the violator. Fines for offenses such as failing to
get a brand inspection start at $100 for a first offense, $150 for a second offense, and $250 for a third offense plus court costs.
For example, if you fail to get a brand inspection and you are issued a citation infraction, the first offense starts at $205. The second offense for the same violation of law is $308, and the third would be $513.
The Livestock Identification program also has the authority to charge a time and mileage fee for the cost of an investigation.
Separate rules for animal health
Separate rules apply to violations of animal health regula- tions. With only a few exceptions, these violations are handled internally by WSDA.
For example, producers who fail to meet health require- ments for importing livestock into Washington State are subject to civil penalties. Because animal health violations fall with-
in the authority of the Administrative Procedures Act, first offenders usually receive warnings, though some exemptions apply.
Penalties for animal health violations vary depending on the nature of the violation. For example, procedural violation penalties start at $150 for the first offense, $350 for the second offense, and $1000 for the third offense.
For animal disease violations, penalties start at $350. They increase to $650 for the second offense and $1,000 for the third plus time and mileage.
