Fall Update:
Libraries have a lot of experience with prioritizing,
preserving, and protecting information. Many people are
discovering the value and necessity of developing these
skills as their personal information and private data (or that of
their clients) is increasingly collected, stored, analyzed, sold, or
stolen online.
The Law Library has several good resources available to help
you learn and understand the legal requirements and best
practices for keeping data private and secure. They cover a
wide range of topics: from listing data security requirements
to explaining data breach reporting and what remedies are
available.
One of the Law Library’s best resources for
learning about privacy and data security
regulations is the aptly titled, Proskauer on
Privacy: A Guide to Privacy and Data Security
Law in the Information Age (2d ed.). The book
offers a historical review of how this area of the
law developed. It also has an excellent review
of international, federal, and state privacy laws and additional
chapters that explain the security and privacy obligations that
apply to certain types of data (e.g., financial records, electronic
communications, or medical records).
Another great resource for learning more about data security
and privacy is Rights of Publicity & Privacy (2d ed.). This is
available electronically using Westlaw and you can read it for
free using one of the Law Library’s two Westlaw computers!
The electronic book offers a detailed legal analysis of this topic.
It also offers helpful insights into some of the
unusual situations that might arise, such as
assignments and licenses or rights after death.
It also provides analysis and commentary on
procedure, remedies, and defenses.
Finally, we have Information Security and
Privacy: A Guide to Federal and State Law and
Compliance (2023). This electronic book is also
available on Westlaw. It has a comprehensive
overview of data security and privacy laws and
regulations. One of its most useful chapters
covers privacy litigation and provides helpful
information about some of the most difficult parts of bringing
a data breach or invasion of privacy case: which theories can be
used to establish standing and how to define the nature of the
damages.
As always, you won’t need to travel all the way to the Law
Library to reap the benefits of our books; you can access many
of our most popular books from anywhere! You will be able to
read those books in our digital library from the comfort of your
home or office. If you have the Internet, then you have the Law
Library in your pocket!
