(b) The carer has ceased to work for Ranger Home Care and the client then contracts directly to employ the carer within 8 weeks since the Carer last provided service with Ranger Home Care. The payment of an introductory fee is £4,000.
12.2 Should you engage our carer directly, you will become responsible for payment of employer national insurance contributions maintaining employer’s liability insurance, holiday pay, sick pay, and all statutory requirements.
12.3 Your obligation under 12.1 (b) will not arise where the engagement of a carer follows a transfer under the Transfer of Undertaking (Protection and Employment) Regulations 2006.
12.4 The introduction by the client of a carer to another employer or agency or similar organisation, resulting in the engagement of the carer by that third party, within six months will render the client liable automatically to payment of the introduction fee referred to in 12.1 (b).
12.5 The client in addition be liable for payment of the introduction fee to Ranger Home Care, in the event that the client introduces any employee of Ranger Home Care to any like business, agency or organisation similar to Ranger Home Care, and that introduction results in the employment of the employee by that business, agency or organisation.
13. Insurance
13.1 Ranger Home Care has the following insurance in place:
(a) Employers Liability Insurance
(b) Public Liability Insurance
(c) Professional Indemnity Insurance
13.2 The client/clients are/is responsible for ensuring:
(a) A suitable building and contents insurance policy is in place to cover accidental damage to the home or its contents.
(b) Should the care service include the carer to drive an alternative motor vehicle, insurance for this vehicle is to include cover for the carer.
14. Liability
14.1 Due to the nature of the service offered by Ranger Home Care to the Client, no liability by Ranger Home Care will be accepted for any loss, expenses or damage or delay arising from any failure to provide a carer for all or part of the period of the contract term.
14.2 This Section (14) sets out the entire financial liability of Ranger Home Care (including any liability for the acts or omissions of its employees, agents, and subcontractors) to the client in respect of:
