amendments proposed by FSTEK, critical networks, information systems of state institutions, banks, military, energy and nuclear energy companies would be considered as critical infrastructure objects.
The Federal Anti-Monopoly Service (FAS) has accelerated the timeline of the so-called “law against Apple.” The regulator issued a draft decree on February 14 outlining implementation procedures for the December 2019 law requiring that smartphones, computers, and smart TVs sold in Russia come pre-installed with domestic software. It stipulates that:
● Starting on July 1, 2020, any wireless communications device with a touch screen and two or more functions must come pre-installed with domestic search engines, web browsers, and navigation services. Device manufacturers note that the wording has become blurred and now applies to not just smartphones, but also to tablets and smart watches.
● On July 1, 2020, the regulation will expand to computers and additionally require Russian-made messaging services, social networks, email systems, antivirus software, and the Mir national payment system. The original legislation did not regulate computers until 2022, and pre-installation of the Mir system was not required until 2023.
● On July 1, 2022, the legislation will expand to smart TVs, requiring domestic AV services and applications that broadcast 20 public channels.
● Lastly, the decree outlines popularity requirements for the pre-installed domestic software. In order to qualify, applications must have at least 100,000 downloads and unique users per month.
