Further to our letter dated 2nd June 2016 referencing your various breaches of covenants, which we note remains unacknowledged, we are advised that your present tenant of Flat 5, Ms M.S. Scarpellini, has recently now departed.
We are also advised (and have seen photographic evidence) that some residual mess was left in the common areas and excessive rubbish was left in the communal dustbins requiring additional work for the cleaners.
Our client requests we refer you to an email to you dated 16 June 2014 from Mr. S. Karupiah (Director, Mitre House Management Limited) prior to this particular tenancy, warning you to firstly comply with your lease covenants as listed and secondly making clear that if you proceeded in issuing a further short term tenancy agreement, it would be considered invalid.
You did neither as requested and issued a Tenancy Agreement to Ms M.S. Scarpellini, now recently relocated.
We would make clear that this was in direct contravention to your lease obligations and if you now proceed in issuing a further short term tenancy agreement to a new tenant we will advise our client to inform your new tenant that it was made outside of your legitimate right to do so and is de facto, invalid. Obviously this will leave you in a very exposed situation as regards your tenant’s rights and obligations and is not advisable.
