And please no accusation of attempting to hide anything or deceive anybody as ALL lessees were advised on numerable occasions to await publication of the 2014 Accounts and review all paperwork (all in our 13 Folder Bundle and advised to Mr Begg on multiple occasions). Did anybody do so? No. Did we offer to bike over the requested invoices on 1st April 2016? Yes. Have we disproved each and every silly accusation and innuendo since Mr Begg’s thirteen page letter of 23 March? Was £11,243 still in Reserves at end works/end of year? No. But £16,201 was? Yes. Are “additional works” in evidence at Mitre House? Yes Are they irrelevant such as Emergency Lighting? No. Were “additional works” discussed and agreed at two meetings called by Mrs Hillgarth in 2012? Yes. Did Mrs Hillgarth propose an RTM application with her Solicitors stating the reason being to adopt her preferred contractor, Wade, for the Internals at a cost of £60,000 to include vat and fees? Yes
So if the Wade costings were not irrelevant it stands to reason the “additional works” which they proposed are not irrelevant. Did MHML manage to accomplish all the Wade workings (and some) costed at £60,000 including vat and fees for £31,756 including vat and fees. Yes
Just exactly how much more were we expected to do?
And if further evidence of Mrs Hillgarth’s contrariness were needed, I would like to add the attached two pdfs to my bundle (and will supply printed copes), with reference to Mr Begg’s Item (10) Other failures to provide information on the s22 Notice, namely:
Flat 5 Invoices 2014.pdf: evidencing both invoices for Window Repairs and her Private work required of our Aerialtec TV/Sky installers - which is referenced in her Witness Statement as being insufficient and unfit for purpose and denying the presentation of a totally illegible cheque for £250. It was confirmed by our bank as unacceptable.
Windows Monies.pdf: evidencing her accusation that MHML were using lessees’ Window Repair contributions for other purposes and like all her other accusations sent to all lessees for their misinformation (such as having my flat refurbished by AR Lawrence; using the basement as an office; not posting all relevant documents on our website; vote rigging; progressing most if not all interior workings personally; using my flat as an office; ignoring legitimate requests from lessees to inspect the 2014 financial documentation; not having explained and gained 100% agreement from all lessees to forego Section 20 Notices for Water Tank and TV/Sky install (which resulted in a saving of £2153 off the quoted costs as scaffolding remained in situ as Management had advised); falsifying accounts despite £16,201 carried forward in Reserves for 2015 as opposed to the predicted £11,243 after the £2000 contribution from all lessees to adequately fund the lessees’ choice of AR Lawrence’s budget of £105,019 including vat and fees with only £98,262 in Reserves - all as stated on the 22 June 2014 Section 20 Notice.
