LANDLORD & TENANT ACT 1985 - SECTION 20C LANDLORD & TENANT ACT 1987 - SECTION 24(1) MITRE HOUSE, 124 KINGS ROAD, LONDON SW3 4TP
Following the directions received in respect of this matter, I, Paul Brown-Constable (“PBC”), a Director (one of two) of Mitre House Management Limited (the “Respondent” “MHML”) am authorised by my fellow Director to make the following statements of fact as regards a further Application by the “Applicant’s” representatives, Maunder Taylor, and I refer to Mr Bruce Maunder Taylor’s letter to the Tribunal dated 26 April 2017 (and copied to ourselves) refer- encing the Tribunal Procedure Rules 2013 in particular, Paragraph 18 thereof.
Before Judge Barran considers whether to make a formal order under Rule 20(b) of the Tribunal Procedure (First- Tier Tribunal (Property Chamber) Rules 2013, we would respectfully request that the following facts, with accompa- nying evidence, be taken into consideration in our request to deny the application for an Order of Disclosure for the reasons stated.
(a) we wish to not provide copies of the financial documents listed to Mr Maunder Taylor by 15 May for the following reasons:
1_ As we understand the Application for Order of Disclosure, it states firstly for: receipts and financial docu- ments for the financial years 2014 to date. It also then states (a) All receipts for the financial years in question, (b) Bank Statements for the years in question and (c) Expenditure ledger sheets for the years in question.
2_ We are presuming the year(s) in question being 2014 (as opposed to 2014 to date indicating 4 years of accounts’ documents to be supplied) as indeed in a thirteen page letter dated 23 March 2016 received from Mrs Hillgarth’s (the “Applicant’ “MH”) Solicitor to “MHML” (“PBC”) it requested sight of 12 relevant “works” original invoices from the 2014 Internal/External major refurbishment at Mitre House during 2014 totalling £105,877. A request that came well outside of the statutory six month period for inspection as laid down in Mrs Hillgarth’s lease and everybody else’s, including (“PBC’s”) own lease and fellow co-director(s).
