Dear Bruce -
Another idea......to possibly bring this latest affair to a fair and equitable conclusion which might find favour with Michele and her pals and avoid yet more costs for either party, including god forbid to the Service Charge! And I do appreciate this might do you out of job for 12 months.
How would Michele react to a "Without Prejudice" offer for MHML to voluntarily cease trading and managing Mitre House from 31 December 2018 and to sell her (give her, donate to her) the Head Lease for a nominal sum of say £100 allowing her to retain Maunder Taylor as Managing Agents. That’s pre-supposing they would want it knowing the recent politics.
As I have previously made clear, I could not afford, nor in truth would wish to, reside at Mitre House if the Quarterlies rise substantially which they quite understandably will and the 18 months grace period between now and end 2018 gives me ample time to make alternative arrangements - and allows full rein for Michele to orchestrate the next works’ programme which you’ll understand I wouldn’t wish to be involved in again! Nor could I afford to be if she again requests Wade to do for upwards and well over £219,000....
I fully appreciate that if she wins the day at the Tribunal then all bets are off, but if she doesn’t (or indeed even if she does) she still does not have the full control as she would have as the rightful owner of the Head Lease and MHML would still remain in existence to upset her (lease covenants etc in tandem with the new Manager’s insistence), or we more likely unload the Head Lease and she takes her chances on getting it for less than £100. In fact she could simply take over MHML for nothing to include the Head Lease once we two last standing directors resign on 31 December 2019 - if we live that long.
Only an idea which might find favour - if not then apologies for raising and we’re back to the fight. Its just that my co-director and I have really had enough of the shenanigans with her, what with the RTM, now this, what next? It’s endless and I’m putting up with all this for £10 a day..... in truth, she’s welcome to it.
Let me know and we'll sign any watertight agreement she or her advisors draw up for MHML to sign and confirm above but please not too much argy-bargy as I don’t have the energy to open yet another front - she wants total control to run Mitre House her way at her idea of cost and expenditure, with her ideas of decor and fitments and this proposal gives her all of that once we (MHML) and most especially myself resign our commissions which we’ll do gladly and I’ll sell up and move out (property prices permitting) so ridding her of what she considers me to be, the devil incarnate!
And having hopefully perused both the website and the accounts info sent to date it is now appreciated that we do things to a degree most likely unheard of from normal managing agents let alone keeping a watchful eye of any expenditure as well evidenced by annual outgoings for all lessees of £800 less today than in 2011 - and with an exemplary works’ programme benefitting the property value of all lessees despite Michele’s and her pals’ misgivings and having more money in Reserves than was ever anticipated.
Not bad for unprofessional, incompetent, dishonest, abusive, blackmailing and non democratic management? Yours sincerely,
Paul Brown-Constable
