For the benefit of doubt, as it appears Flat 5’s Michele Hillgarth is still inferring via her Solicitor that MHML (your previous management), fraudulently stole money from you during the 2014 Major Works (Internals & Externals).
You can add this accusation to other lies she told you on numerous occasions during the run up to these works and during the works and subsequent to the works and indeed during her failed RTM (Right To Manage) application, whilst a Director of MHML in 2013 when she was insisting on using her preferred contractor, Wade, which some lessees were also in agreement with and inadvisably party to. Michele (and her Solicitors) had overlooked the 25% ruling she herself had advised all lessees in 2011 resulting in months of delays and subsequent substantial costs?
To clarify the actual truth of these matters I would remind you of the following:
1_The 2014 Major Works Programme budget of £105,000 did not include a multitude of interior works that Michele Hillgarth, her alleged majority of other lessees, and most certainly MHML all wished to be included but due to affordability, they could not be and consequently were not included. All as advised in detail on www.mitrehouse.com
2_During a MHML Board Meeting on 23 May 2014 this problem was discussed in a 7 hour meeting with Michele Hillgarth and it was proposed to Michele by both Segar Karupiah and myself that we could attempt to make savings from the approved £105,000 budget due to it including some substantial contingency monies, some exterior works which were cosmetic and considered by our Surveyor not critical to be done, and many internal items that MHML proved could be done far cheaper than quoted by ALL our anticipated contractors, including AR Lawrence.
3_Fortuitously this entire 7 hour meeting was tape recorded, in the full knowledge of all participants including Michele, and on this tape recording Michele can be heard exclaiming “will be used for something else”, followed by “well then everybody will be happy” when it was explained to her by both Mr Karupiah and myself that we could hopefully make enough savings, any way we could, to adequately pay for those internal items that were not scheduled to be done, nor included in the Schedule of Works, nor in the £105,000 budget, as they were unaffordable.
If you are in any doubt whatsoever as to the veracity of the points above, or any statement made in this letter to all lessees, you can request the following from me or indeed Michele, or her Solicitor:
a) The Surveyor’s full Schedule of Works for the £105,000 budget so you can identify each and every workings to be performed and only those.
b) References to the unaffordable works which do not appear in the above Surveyor’s full Schedule of Works for the £105,000 budget
c) References to the works arranged by MHML more economically than quoted by AR Lawrence (or indeed any of our 5 tenders)
d) A copy of the full 7 hour recording / or just the relevant clip where Michele can be heard exclaiming “will be used for something else”, followed by “well then everybody will be happy”
e) References and proof to statements made in this letter
f) References to other accusations MHML consider lies/innuendos/mischief/ignorance/malicious/spite
