THAT’S A VERY REASONABLE £400PA PER LESSEE INCREASE OVER A SIX YEAR PERIOD AND ALMOST UNHEARD OF FOR A CHELSEA RESIDENCE WITH A LIFT AS BETTER EVIDENCED BY THE INFORMATION BELOW - THE £10,000PA INCREASE?
HARDLY POOR MANAGEMENT? £400PA ADDITIONAL OVER A SIX YEAR PERIOD...!!!
IN 2019, OUR PRESENT MANAGING AGENTS, MAUNDER TAYLOR, CHARGE £7995 FEES AND QUARTERLY SERVICE CHARGE DEMANDS OF £2,500
4. an e-mail sent by Paul Brown-constable to mrs hillgarth on 14 october 2013 at 18.21 is indicative of his real intentions. he claims that he can make her money by utilizing their col- lective facilities and abilities. “Were you to tell me you had an idea to make me money i doubt i would complain too much”.... “think about the money we could be making if we were all pulling together instead of in-fighting”.
A CONSIDERED RESPONSE: THIS ADEQUATELY STATES THE BEHAVIOUR WE WERE EXPERIENCING WITH MRS HILLGARTH’S INTRANSIGENCE IN “pulling together instead of in- fighting”. THE INFERENCE THAT “indicative of his real intentions” IS SIMPLY PROVOCATIVE AND MISINTERPRETED FOR THE BENEFIT OF YOUR CLIENT. IT WAS SENSIBLE COMMON SENSE BUSINESS PHILOSOPHY. HAD SHE HAD AN OUNCE OF BUSINESS ACUMEN MHML WAS A PERFECT VEHICLE FOR AN NTERIOR DESIGN & REFURBISHMENT CONSULTANCY
5. it was questionable whether mhml or its directors were entitled under the terms of the individual sub-leases to charge the leaseholders/tenants for carrying out the functions of a man- aging agent. however mhml ploughed ahead – since nobody could stop it – and it seriously abused its position as head lessee by imposing management charges on the leaseholders/ten- ants at market rates comparable with or exceeding those which would be charged by an appro- priately qualified and regulated managing agent offering relevant safeguards, such as professional indemnity insurance.
A CONSIDERED RESPONSE:ALL LESSEES INCLUDINGYOUR CLIENT WERE ADVISED OF LEGAL PROCEDURES AT THEIR DISPOSAL IF THEY HAD ANY COMPLAINTS ABOUT ANY ASPECTOFMHML’SRUNNINGOFMITREHOUSE.ANDOFCOURSEWEWEREFULLY ENTITLED TO CHARGE A FEE FOR SERVICES RENDERED AS DOES ANY LANDLORD
OUR FEES OF INITIALLY IN 2012 OF £4320 WERE FAR CHEAPER THAN VARIOUS QUOTES RECEIVED. IN AN EMAIL FROM MRS HILLGARTH DATED 14 DECEMBER 2011 SHE QUOTES £475 PLUS VAT PER EACH OF 9 FLATS FROM SMITH WATERS AGENTS - A TOTAL FEE OF £5130PAWHOMSHEWASRECOMMENDINGIFWEDECIDEDONRETAININGAGENTS?
6. this situation caused serious tensions with those leaseholders who were not directors or shareholders of mhml, and also between the directors themselves. michele hillgarth, whose sole interest was in having the block managed by honest and competent professional managing agents, was removed as a director of mhml by the other three, on 18 september 2014.
