(Note that the leaseholders/tenants of Flats 2, 6 and 7 respectively are the three Directors of Mitre House Management Limited. The leaseholder of Flat 1 is believed to be resident overseas and has no substantive involvement in the matters referred to herein).
(comment/reply) then why indicate Flat 1 as I can assure you, both they and their Agents will side with MHML in any further mischief that Mrs Hillgarth progresses...all indicative of only 4 lessees allegedly in sympathy with your client and indeed if push comes to shove over hiring outside Agents and higher Service Charges, you’ll lose Flats 3 and 8 within 24 hours...
It should be noted that NONE of the above reside at Mitre House as live in residents!
Second Schedule - Grounds for the appointment of a manager:
1 Mitre House Management Limited ("MHML" or “the landlord"), which is the head lessee of the Prop- erty, is currently purporting to manage the Property on behalf of all the leaseholders/tenants at the Property, and to charge them for doing so. However it is questionable whether MHML or its directors are entitled under the terms of the leases to charge the leaseholders/tenants for carrying out the func- tions of a managing agent.
(comment/reply) patent nonsense - our Head Lease makes clear fees can be charged as does common law - how many more times are you to raise this issue and be told it’s rubbish?
2 Neither MHML nor its directors have the qualifications, experience or competence to manage the Property (or any other property).
(comment/reply) patent nonsense - even your client is on record as referring to Agents as mon- keys and as previously stated in previous correspondence, if you can read and write and rea- sonably educated and willing to learn the ropes and the legalities, anyone can and is perfectly permitted to, mange a small building such as Mitre House - your stupid repeated comment falls at the first hurdle when hundreds if not thousands of RTM companies adequately maintain their buildings so please, as above, desist in repeating rubbish.
3 MHML purported to have qualifications and experience relevant to the management of the Property by making claims and representations on its website which were not true (these claims and representa- tions having been plagiarized from the website of a reputable property management company).
(comment/reply) already well covered in previous correspondence - apologised for and ac- cepted by Canonbury - purely a spiteful complaint by your client etc - how many more times are you to raise this issue and be told it’s no longer contentious?
4 MHML is precluded by the terms of its head lease, and the directors of MHML are precluded by the terms of their respective leases, from running a business at the Property, and therefore should not be conducting the management of the Property at/from Mitre House.
(comment/reply) already well covered in previous correspondence - Flat 7 is not running a busi- ness but on site 24/7 for the benefit of all lessees - it has a 24/7 emergency telephone, a printer for Quarterly Demands and a computer to answer your voluminous correspondence containing such irrelevancies as this repeated innuendo. Refer to your client’s Witness Statement for fur- ther comment “old girlfriends”, the “basement”, “Knightsbridge”, “Dorset” and “Sri Lanka”
