“You have already received all the requested invoices - months ago.” [Which was true but only the relevant invoices from MHML to Flat 5 and not the contractors original invoices for obvious reasons - as they were totally irrelevant to Mrs Hillgarth or her accountant - unless she was insinuating something]
This was then followed by her continued harassment for yet further information (she requested the actual original supplier’s invoices addressed and invoiced to MHML as opposed to those invoices MHML had issued to her and other Lessees for their percentage share, as is quite normal under the circumstances and all relevant quotes for these works had been supplied in detail to all lessees, including Mrs Hillgarth - and agreed to be shared without the need of an LVT dispensation). All lessees had agreed to this.
My final reply of 23 March 2015 made abundantly clear the facts (see below: making clear she could view available [original contractor’s invoices] documents once the accounts for 2014 were published - which they were two months later but no request came again from Mrs Hillgarth nor any other Lessee within the statutory 6 month period [or at any time afterwards] until Mrs Hillgarth’s email dated 10 December 2015 and raised yet again in your letter (Mr. Begg’s) of 23 April 2016 - and then answered in full by return almost, with our full agreement to comply to request in our reply dated 1 April 2016, but ignored.
My reply dated 23 March 2015 to Mrs Hillgarth -
“Those invoices you are now requesting have nothing whatsoever to do with your personal/business accounts and will be available to view once the annual accounts are finalised”. [and they were [the accounts] and sent to Mrs Hillgarth and all other lessees on 7 June 2015] ...”I cannot believe that it's taken now half a dozen emails, me sourcing yet again all relevant invoices which are relevant to your personal/business accounts, sending them for a third time and all you actually want is original supplier invoices.”
“Try going into Printemps and buying some shoes and asking to see the shop's invoice from China for making the shoes.”
“Be very careful about your insinuations that I or Management, or indeed anybody is fiddling invoices, taking bribes, taking kick-backs etc, as that is what you are implying and if you do so again you will be brought to account, legally.”
“Your incompetence, ignorance and insinuations simply defy description and in view of the fact that you remain seriously in breach of your lease obligations, I suggest you attend to those matters very promptly as Management will, once the annual accounts have been finalised, refer the outstanding matters to our Solicitors.” [this must be the 7th or 8th time we’ve made this request but in the interest of good relations we had not proceeded - but many email requests are on file for compliance but always ignored].
k) A/cs for year end 2014 were dated 30 May 2015 and were sent to all Lessees on 7th June 2015.
l) There were no requests for any information nor comment from any Lessee including Mrs Hillgarth during the statutory 6 month period until her request in an email dated 10 December 2015 as below:
“I vaguely remember requesting a break-down of the costs for the refurbishment @ Mitre House. Could you please forward this on as by now you should have all the documents in place as the accounts have been finalised. Just the information would be great.”
My reply dated same day 10 December 2015
Michele - I can’t recall any previous request but you can check the website - all relevant information is there, quotes, budgets, breakdowns, costs, section 20 notices, accounts and analyses etc and always has been since day one. I’m on furlough/vacation now until the New Year and resting - need it after a very busy 3 years - Paul” [it is fully admitted that the 14 original invoices you are now requesting were not in evidence on our website but Mrs Hillgarth was not requesting these same 14 (or 10 relevant) invoices - but a breakdown of the costs for the refurbishments, which certainly was in full evidence on our website.]
