Your response to Mr Fortunati’s considered , reasonable and well-reasoned e-mail speaks for itself. On 22 September 2014 you replied to Diego and Susanna Fortunati (copying a number of other leaseholders): “Thank you for your predicted and anticipated email – all of which has been covered in previous emails [actually it hadn’t] and all of which indicate a total ignorance of good management and Landlord & Tenant Act. [Actually the opposite is true; Mr Fortunati’s e-mail demonstrates a good grasp of both]. I can’t work out whether you are totally stupid or just retarded – I suspect both”....... “How about if we got lucky and you got run over crossing the road?”...... “Which word don’t you understand in Pay up or Shut up....?”
Mrs Fortunati again with the identical queries from Mrs Hillgarth’s other cohorts – to be fair my reply although appearing unchristian is out of total frustration as getting these same few lessees to stop and either comply or advise not doing, re: every process – the various tenders versus their tenders, the £12,000 for Wade’s £219,000 quote, the £2000 for Lawrence quote, the TV installation, the tank installation etc etc – each and every stage embroiled me in reams of letter writing mostly stating the very same facts and figures.
In a separate response to Mrs Hillgarth’s e-mail of 29 September 2014 (also copied to other lessees) you wrote: “In truth I couldn’t give a rats arse whether the water tank gets replaced”.
Already answered elsewhere – I think my frustration is graphically apparent and in answer to your next paragraph, were any previous agent rude to Mrs Hillgarth she would crucify them with a barrage of complaints to their supervisors, management, LVT and any other ear she could bend. She would not rest until they were fired. At least I know what they say out of earshot. Ungentlemanly I agree, but true.
Your belligerence was such that on 30 September 2014 Mrs Hillgarth felt the need to be accompanied by a police officer when she attended at your flat to collect some keys. She had felt very apprehensive following your e-mail of 13 September 2014 in which you stated that “I’ve had enough of your duplicity and yes [referring to Mrs Hillgarth’s visit the previous day] I slammed the door. I just don’t trust you and in the present climate, it would not be advisable for us to be in contact unless others are present”. Rudeness of any sort is never acceptable from a proper managing agent. Flagrant abuse of this kind borders on criminality.
Mrs Hillgarth misunderstood my comment which was based on two or three previous situations.
Correspondence between myself and Mrs Hillgarth evidences very serious contradictions as to agreements and conversations, to the extent that I did not trust a word she said to my face and then an email would go out to all lessees saying something totally different (I do
