1. INTRODUCTION;
Mrs Michele Hillgarth (“MH”) the applicant considers Mr Paul Brown- Constable (“PBC”) the Respondent and director of Mitre House Management Limited (“MHML”) to have committed various serious misdemeanours in the course of his duties during a major Internal and External works refurbishment at Mitre House, 124 Kings Road, London SW3 4TP during 2014. (“PBC”) denies all accusations and maintains that (“MH”) had agreed to all procedures to be adopted during the Works programme but due to disagreements over other matters com- menced a campaign of discontent against both (“PBC”) and (“MHML”)
2. THE ISSUES;
(“MH”) and (“PBC”) along with two neighbour lessees purchased the Head Lease of Mitre House (nine, one bedroom flats in a small purpose built block of flats) in 2011 and formed (“MHML”) to manage the building. (“MH”) was not as enthusiastic as her three fellow Directors but agreed to give it a try. This non-enthusiasm very quickly turned to total animosity over budgets to be appropriated for the works pro- gramme. (“MH”) wished to spend far more than (“PBC”) and her fellow Directors wished to spend and (“MH”) progressed an RTM application citing her preferred Contractor and their budget as the reason.
