SAMOA IS A COUNTRY MADE UP OF 4 PRIMARY ISLANDS AND A SERIES OF SMALL UNINHABITED ISLANDS. THERE IS A POPULATION OF AROUND 210,000.
Trade mark protection
A Samoan trade mark application can be registered in accordance with the Samoan Intellectual Property Act 2011 which became effective in 2012. Trade marks filed under the previous Act will be treated as if they were filed under the new Act.
The legislation allows for multiclass applications, colour, shapes, sounds, smells and tastes, both goods and services and series of trade marks.
Samoa is a member of the Paris Convention.
Patent protection
A Samoan patent application can be granted in accordance with the Samoan Intellectual Property Act 2011 which was effective in 2012. Samoa offers two types of patents namely standard patents and innovation patents. Samoa is a member of the Paris Convention.
Design protection
A Samoan design registration can be granted in accordance with the Samoan Intellectual Property Act 2011 which was effective in 2012. The registration lasts 5 years and can be renewed for two further 5 year periods.
