Cook Islands

Trade mark protection
Cook Island trade mark protection was previously included in the New Zealand Trade Mark Act 1953. Trade marks registered under the 1953 or earlier
New Zealand Acts continue to have IP protection in the Cook Islands. This Act was replaced by the Trade Mark Act 2002 in which there was no mention of the same protection. Currently, no legislation exists to register new trade marks in the Cook Islands.
The best option for obtaining trade mark protection in the Cook Islands is to issue a cautionary notice. We recommend that cautionary notices be published every two years, and ideally annually.
Patent protection
Patents granted in New Zealand under the Patent Act 1953 have IP protection in the Cook Islands.
Currently, no legislation exists to register new patents in the Cook Islands.
Design protection
A New Zealand design registration extends to the Cook Islands.
