Cautionary Notices
In countries where there is limited intellectual property legislation, cautionary notices are available as the best option for IP protection.
A cautionary notice is a publication in a local newspaper regarding the registration and ownership of a mark. Although not enforceable in the same manner as a registration, it notifies third parties of the owners’ rights and acts as a warning to potential infringers. The cautionary notice is intended to create evidence of a reputation in the relevant jurisdictions for the purposes of a common law passing off action or regulatory action in the future.
