Fiji
FIJI IS AN INDEPENDENT ISLAND COUNTRY MADE UP OF OVER 300 ISLANDS. THE MAJORITY OF THE POPULATION LIVES ON 2 OF THE ISLANDS, VITI LEVU AND VANUA LEVU. THE TOTAL POPULATION OF FIJI IS AROUND 920,000.
Trade mark protection
In Fiji, the Trade Marks Act of 1933 governs trademark registration, which is, in turn, based on the UK Trade Marks Act of 1905. Trademark registration and protection in Fiji may be obtained by filing a national trademark application using the old UK classification system directly in Fiji or filing an application based on a United Kingdom registration.
Currently, there are two types of trade mark applications that can be filed in Fiji:
a. A standard trade mark application b. An application based on a United
Kingdom trade mark application
Multiclass applications and service classes are not available in Fiji. Fiji has their own classification system. Fiji is not a member of the Paris Convention.
In 2021, a new Trade Mark Act was introduced in Fiji. It is yet to come into force. Some of the changes include the adoption of the Nice Classification system and the Paris Convention. Once it comes into force, there will be changes to the trade mark registration process in line with the international system.
Patent protection
There are two types of patent applications that can be filed in Fiji:
a. A national patent application
b. An application based on a United
Kingdom registration. This application must be applied for within three years of the date of issue of the United Kingdom Patent.
Fiji is not a member of the Paris Convention.
In 2021, a new Patents Act was introduced in Fiji. Once it comes into force, there
will be changes to the patent registration process.
Design protection
A United Kingdom design registration extends to Fiji.
