Challenging a summary punishment
I want to address the issue of challenging summary punishment and SPAR forms. Many officers become confused between the summa- ry punishment appeal process and the grievance procedure. It is important that the time limits are observed and that all To/From reports are submitted by the end of the next tour of duty. It would be best to complete and submit the To/ From as soon as possible so that the officers are assured of having access to the appeal process.
Step one: When an officer receives a SPAR form giving sum- mary punishment, they should check the box “Request Hear- ing” and submit a To/From report. The To/From report must be completed and submitted by the end of the next tour of duty. The To/From should state the reasons for appealing the summary punishment and should be attached to the SPAR form when submitted.
Step two: Request a hearing with the commanding officer. The officer should be prepared to present their case and en-
sure that any reports relevant to their defense are brought to the hearing. The commanding officer will then present the SPAR form to the officer after checking the appropriate square in the “C.O./Exempt Rank Review” box. If the officer chooses not to accept the penalty, they should check the box “Additional Request Hearing” and submit another To/From requesting a hearing with the next member in the chain of command. This To/From report must be submitted before the end of the next tour of duty.
Step three: A hearing will occur with the next command person in the command channel. This is usually the area deputy chief. The officer should be prepared to discuss the summary punishment. At the conclusion of this hearing, the deputy chief will inform the officer of their decision.
