Compliance Bulletin 76
GDPR, Insurance Distribution and Transparency
“We strive to provide an excellent service to all our clients. Please note that we are authorised and regulated by the Solicitors Regulation Authority (registration number xxx) whose rules can be consulted at www.sra.org.uk/handbook. In accordance with the SRA requirements we operate a complaints handling process, a copy of which is available on request to our clients. Complaints may also be referred to the Legal Ombudsman in certain circumstances.”
You may however prefer something more comprehensive.
Also, easily overlooked is the forthcoming requirement to show the SRA registration number. The current SRA Code of Conduct requires at Outcome 8.5 that either the firm’s SRA registration number or its LLP or company number to be shown on its “letterhead, website and emails”. However, rule 4.1 of the Transparency Rules (currently “greyed out on the SRA website to indicate that the provision is not yet live) will require that a firm’s SRA registration number appear regardless of the legal status of the firm and of whether they show the LLP or company number – which of course will need to continue to be shown where the firm is either an LLP or limited company. It is suggested that those firms who have not done so already, add the SRA number to their letterheads and websites so as not to get caught out when the provision comes into effect.
Also, don’t forget the requirements as to the SRA digital badge. Although details of the badge were originally promised in November it has only just appeared on the SRA website. Fortunately, it will not become compulsory until Spring 2019. Do be aware, however, that if you have not already done so you need to check or add your website within mySRA since you will only be able to use the badge if the SRA have an accurate website address for your firm.
