Man To Pay $1.2 Million To Victims In Fraud Scheme
A 49-year-old Clearwater man was sentenced to prison last Friday. He pleaded guilty to com- mitting wire fraud on April 30, 2019.
U. S. District Judge Mary S. Scriven sentenced Richard Buffington to 3 years and 10 months in federal prison. The Court also ordered Buffington to forfeit more than $1.2 million, which is traceable to the pro- ceeds of the offense, and to pay more than $1.2 million in resti- tution to the victims of his fraud scheme.
According to court docu- ments, beginning in January 2013 through August 29, 2018, Buffington defrauded approxi- mately 28 investors, from Florida and across the United States, out of more than $1.2 million by sell- ing unregistered, non-exempt se- curities in the form of preferred shares. He made false and fraud- ulent representations to victim-
investors about the need for fund- ing for Green Street Equi- ties (“GSE”).
Buffing- ton, GSE’s listed Chair- man and RICHARD President, BUFFINGTON pitched GSE as a company focused on investing in “green companies” (i.e., environmen- tally friendly projects). Buffing- ton’s misrepresentations to investors included that, GSE would go public soon after the in- vestors’ stock purchase, and that GSE would use investor money to acquire ownership interests in various companies in the “green
energy” sector.
Based on Buffington’s mis-
representations, victim-investors sent funds believing that Buff- ington would use such money to fund GSE and its investments or acquisitions.
Investors accepted his mis- representations about GSE be- cause prior to 2013, he had successfully raised funds for a company that had gone public and from which investors had profited.
In the end, although Buffin- gton marketed GSE as a com- pany making meaningful investments or acquisitions in “green companies,” neither GSE nor Buffington ever made any such investments or acquisitions.
Instead, Buffington used any monies that he raised, in- cluding money wired by an un- dercover agent, for his personal benefit, which included drinking, gambling, and drug use.
