Lakeland Man Fatally Wounded After Raising Gun At Deputy
A 60-year-old man died Friday morning after being shot by police. The shooting took place after the man re- portedly raised a handgun after being told to drop it.
According to the Polk County Sheriff’s Office, the shooting took place at 1505 Saddlehorn Drive, in Lake- and around 10:30 a.m.
Officers were dispatched to the residence after a 9-1-1 call came into the Emergency Communications Center.
The caller identified him- self as Kenneth Layton, the homeowner. Layton re- ported that someone was banging on his door, trying to get into his home, and that the man had a gun.
He remained on the tele- phone with the dispatcher until Deputy Chad Nichols arrived, and re- mained on the phone during the entire incident.
Deputy Nichols, a 15- year veteran with the Polk County Sheriff’s Office, at- tempted to make contact with Layton at the front door.
When the front door opened, Deputy Nichols observed Layton with a handgun at his side. Deputy Nichols then backed away from the front door, and Layton followed him, police said.
Deputy Nichols told Layton repeatedly to drop his gun. However, Layton did not obey the command and raised the gun, forcing Deputy Nichols to fire one shot into Layton’s chest.
Deputy Nichols began administering first aid im- mediately and requested Polk Fire Rescue to respond to the scene.
Layton was transported from the scene to a local hos- pital, where he was pro- nounced deceased.
Polk County Sheriff Grady Judd said, “This ap- pears to be a classic example of suicide-by-cop. There is no evidence at this point in the investigation that there was ever anybody trying to get inside his house. Our deputy had no choice but to shoot him. I feel bad for this man’s family and friends, but I am happy our deputy was not hurt.”
Detectives have heard from a neighbor that Lay- ton’s wife passed away earlier this year and they are investigating that to deter- mine if it played any part in his behavior.
As is standard practice, Deputy Nichols was placed on administrative leave pending the outcome of the investigation.
