Bill Cosby Can Plead The Fifth In Civil Sexual Assault Suit, Judge Rules
Donny Gerrard Dead: Skylark Lead
When his sexual assault con- viction was overturned by Pennsylvania’s highest court, Bill Cosby theoretically be- came constrained in his ability to invoke his Fifth Amendment right not to incriminate him- self. Attorneys for Judy Huth, who sued in 2014 claiming the comedian sexu- ally assaulted her in 1974 at the Playboy Mansion, moved to depose Cosby after the rever- sal because there was no longer any active criminal in- vestigation.
L. A. County Superior Court Judge Craig Karlan found on Friday that Cosby can con-
questions that may land him in legal trouble, pointing to the possibility of being prosecuted again if new information is un- covered from his testimony in this case.
“I don’t think that by virtue of the fact that the Los Angeles Police Department said the in- vestigation is closed or the Dis- trict Attorney’s Office said we’re not prosecuting at this time, that he’s clear,” Karlan said. “If new evidence came up, nothing prohibits the police department or District Attor- ney from opening a new inves- tigation. There are tons of cases that have done that.”
