  Custodian Form Minor Under the New Jersey Gifts to Minors Ace:
Death of a Minor:
Secure Surrogate’s Certificate covering the appointment of the personal representative of the decedent.
Death of a Custodian:
A new Custodian must be appointed by the Superior Court of New Jersey. Power of Attorney is not permitted.
Deceased Checking Account Customer
Upon receiving notification of the death of a checking account customer, it will be necessary to notify the Customer Service Dept. so that the account is placed on a waived service charge status (This is the Bank’s duty). The Banking laws of N.J. state: No bank or trust company after having received notice of the death of a resident depositor shall impose or collect a fee or service charge in connection with the maintenance of a checking account during the period when the funds in said account may not be withdrawn pending consent thereto by the Director of the Division of Taxation. In addition, it is important to obtain the date of death. One-half of the monies on deposit as per date of death must be held pending the receipt of an Inheritance Tax Waiver. Checks may be outstanding and the bank may continue to pay checks drawn by the
deceased customer prior to death for ten days after the date of the decedent’s death. Any notification of a deceased depositor can be accepted by phone, in person or letter and will require preparing a listing of all accounts in the bank.
Power of Attorney Deceased Accounts
Power of Attorney ceases upon death. Acceptance of checks signed by the Power of Attorney prior to the date of death but received for payment following the date of death may be paid up to ten (10) days following the date of death of the checks are for routine bill paying, and appear to be valid when written.
In all cases, discretion should be used in judging validity and valid Power of Attorney signature card must be on file.
Documents Required in Event of Death
1. Certified Death Certificate - in all cases.
2. Resident of New Jersey.
3. Surrogates Certificate, appointing an
executor, administrator, etc.
4. Inheritance Tax Waiver, Sate of N.J

5. Non-resident of N.J. - Surrogate
Certificate and Affidavit of Domicile. 6. Positive identification of the person names in the Surrogate Certificate is an absolute requirement before releasing
funds.
