ค์ณะกรรมการการประกอบธุุรกิจของค์นต่่างด้้าว ด้ําาเนินการทบทวนประเภทธุุรกิจบัญชีีท้ายพิระราชีบัญญัต่ิ การประกอบธุุรกิจของค์นต่่างด้้าว พิ.ศ. 2542 เป็นประจําา ทุกปี โด้ยได้้มีการแต่่งต่ังค์ณะอนุกรรมการพิิจารณาทบทวน ประเภทธุรุ กจิ ต่ามบญั ชีที า้ ยพิระราชีบญั ญต่ั กิ ารประกอบธุรุ กจิ ของค์นต่า่งด้า้วพิ.ศ.2542เพิอืพิิจารณาทบทวนประเภทธุุรกิจ ต่ามบัญชีีท้ายพิระราชีบัญญัต่ิฯ และสืรุปผลการพิิจารณา และ เสืนอค์วามเห้น็ ต่อ่ ค์ณะกรรมการฯ พิจิ ารณากอ่ นทาํา ค์วามเห้น็ เสืนอรัฐมนต่รีต่่อไป
ในปี 2567 ค์ณะกรรมการฯ ได้้มีการกําาห้นด้เกณฑ์์ การพิิจารณาเชี่นเด้ียวกับทุกปีทีผ่านมา ได้้แก่ 1) เป็นธุุรกิจ ต่ามบัญชีีท้ายพิระราชีบัญญัต่ิฯ 2) เป็นธุุรกิจทีพิิจารณาต่าม เงอื นไขของบญั ชีห้ี นงึ บญั ชีสืี อง และบญั ชีสืี าม 3) เปน็ ธุรุ กจิ ทมี ี กฎห้มายกาํา กบั เฉพิาะ 4) เปน็ ธุรุ กจิ ทสืี อด้ค์ลอ้ งกบั สืภาพิการณ์ ทางเศรษฐกจิ และการพิฒั นาเศรษฐกจิ ในภาพิรวม 5) เปน็ ธุรุ กจิ ทีมีค์วามเห้็นจากห้น่วยงานทีเกียวข้องกับรายการธุุรกิจ และ 6) ข้อด้ี ข้อเสืีย ทีจะเกิด้ขึนจากการทีธุุรกิจไม่อย้่ภายใต่้การ กาํา กบั ของ พิ.ร.บ. การประกอบธุรุ กจิ ของค์นต่า่ งด้า้ ว พิ.ศ. 2542 โด้ยใชีม้ าต่รา 5 ของพิระราชีบญั ญต่ั ฯิ เปน็ กรอบในการพิจิ ารณา
สืาํา ห้รบั รายการธุรุ กจิ ทเี สืนอให้ท้ บทวนเพิอื นาํา ออกจาก บัญชีีท้ายพิระราชีบัญญัต่ิฯ ประจําาปี พิ.ศ. 2567 พิิจารณา โด้ยเป็นธุุรกิจทีเค์ยเสืนอทบทวน เป็นธุุรกิจทีสือด้ค์ล้องกับ อุต่สืาห้กรรมเป้าห้มาย เป็นธุุรกิจทีมีกฎห้มายเฉพิาะห้รือ ห้น่วยงานเฉพิาะกําากับ ห้รือเป็นธุุรกิจบริการให้ม่ ทีสือด้ค์ล้อง กับนโยบายของรัฐบาล/ห้น่วยงานเสืนอ โด้ยมีรายการธุุรกิจที นําามาพิิจารณาทบทวน ด้ังนี
1) ธุุรกิจการให้้บริการด้ิจิทัลค์อนเทนต่์(แอนิเมชีัน) 2) ธุุรกิจการให้้บริการด้ิจิทัลค์อนเทนต่์(ค์าแรค์เต่อร์) 3) ธุุรกิจการให้้บริการด้ิจิทัลค์อนเทนต่์(เกม)
4) ธุรุ กจิ บรกิ ารซอ่ มบาํา รงุ อากาศยาน ต่ามกฎห้มายวา่
ด้้วยการเด้ินอากาศ
5) ธุุรกิจบริการซ่อมบําารุงรถไฟฟ้าขนสื่งมวลชีน

Another important role of the Foreign Business Commission is to review the business lists annexed to the Foreign Business Act, B.E. 2542 (1999) every year (Section 9, Paragraph 2). The review process begins with the establishment of the Sub-Committee on Revision of Business Lists Annexed to the Foreign Business Act, B.E. 2542 (1999). The role of this Sub-committee is to consider and discuss the revision of the business lists annexed to the said Act, draw a conclusion (with opinions) on the revision, and submit the written conclusion to the Commission before proposing it to the Minister.
In 2024, the Commission continues to review business types. The criteria for consideration are the same as in previous years, namely: 1) It is a business according to the list annexed to the Act. 2) It is a business that is considered according to the conditions of List One, List Two and List Three. 3) It is a business under specific laws; 4) It is a business that is in line with economic conditions and overall economic development; 5) It is a business that has opinions from agencies related to the business; and 6) Advantages and disadvantages that will arise from the business not being under the supervision of the Foreign Business Act B.E. 2542 (1999) by using Section 5 of the Act, is a framework for consideration.
The proposed businesses to be reviewed and removed from the list annexed to the Act for the year 2024 considered as a business that has previously been proposed for review, or it is consistent with the target industry or it is a business that has a specific law or a specific agency to regulate it, or it is a new service business that is related to the government’s policies. There are 10 businesses proposed to be reviewed:
1) DigitalContentServices(Animation) 2) DigitalContentServices(Character) 3) DigitalContentServices(Game)
4) Aircraftmaintenanceservices
5) Masstransitelectrictrainmaintenanceservices
6) Ship repair and maintenance services of sizes from 500 gross tons and above
