2.3 ประเภทธุรกิจทีเสนอให้พิจารณาทบทวนออกจากบัญชีท้าย่ฯ
The category of business to be proposed to undergo a review in order to remove it from the lists annexed to the Act
ในปี 2567 ค์ณะกรรมการการประกอบธุุรกิจของ ค์นต่า่ งด้า้ ว พิจิ ารณารายการธุรุ กจิ ทเี สืนอให้ท้ บทวนเพิอื นาํา ออก จากบัญชีีท้ายพิระราชีบัญญัต่ิฯ โด้ยเป็นธุุรกิจทีเค์ยเสืนอ ทบทวน เป็นธุุรกิจทีสือด้ค์ล้องกับอุต่สืาห้กรรมเป้าห้มาย เปน็ ธุรุ กจิ ทมี กี ฎห้มายเฉพิาะห้รอื ห้นว่ ยงานเฉพิาะกาํา กบั ห้รอื เปน็ ธุุรกิจบริการให้ม่ทีสือด้ค์ล้องกับนโยบายของรัฐบาล/ห้น่วยงาน เสืนอ โด้ยมีรายการธุุรกิจทีนําามาพิิจารณาทบทวน ด้ังนี
1) ธุุรกิจการให้้บริการด้ิจิทัลค์อนเทนต่์(แอนิเมชีัน) 2) ธุุรกิจการให้้บริการด้ิจิทัลค์อนเทนต่์ (ค์าแรค์เต่อร์) 3) ธุุรกิจการให้้บริการด้ิจิทัลค์อนเทนต่์(เกม)
4) ธุุรกิจบริการซ่อมบําารุงอากาศยาน ต่ามกฎห้มาย
ว่าด้้วยการเด้ินอากาศ
5) ธุุรกิจบริการซ่อมบําารุงรถไฟฟ้าขนสื่งมวลชีน
6) ธุรุ กจิ บรกิ ารซอ่ มบาํา รงุ เรอื ขนาด้ต่งั แต่่ 500 ต่นั กรอสื

ในด้้านใด้ด้้านห้นึง โด้ยการศึกษาทบทวนประเภทธุุรกิจด้ังกล่าวจะด้ําาเนิน
การศึกษาต่ามเกณฑ์์การพิิจารณาของค์ณะกรรมการฯ ซึงจะมี ขอ้ มล้ เกยี วกบั โค์รงสืรา้ งและสืภาพิการประกอบธุรุ กจิ ศกั ยภาพิ และขีด้ค์วามสืามารถของผ้้ประกอบการไทย และผลด้ีผลเสืีย ของการเข้ามาประกอบธุุรกิจของค์นต่่างชีาต่ิมาประกอบการ พิิจารณาด้้วย รวมถึงมีการรับฟังค์วามเห้็นจากห้น่วยงาน ทีเกียวข้องซึงผ้้มีสื่วนได้้เสืียกับธุุรกิจทีพิิจารณาทบทวนด้้วย เพิือให้้การทบทวนธุุรกิจบัญชีีท้ายมีค์วามทันสืมัยและเห้มาะ กับสืภาวะการค์้าการลงทุนของประเทศ
This year the proposed businesses to be reviewed and removed from the list annexed to the Act considered as a business that has previously been proposed for review, or it is consistent with the target industry or it is a business that has a specific law or a specific agency to regulate it, or it is a new service business that is related to the government’s policies. There are 10 businesses proposed to be reviewed:
1) DigitalContentServices(Animation) 2) DigitalContentServices(Character) 3) DigitalContentServices(Game)
4) Aircraftmaintenanceservices
5) Masstransitelectrictrainmaintenanceservices
6) Shiprepairandmaintenanceservicesofsizes from 500 gross tons and above
7) Lifeinsurancebrokerage,accordingtothelaw on life insurance
8) Non-lifeinsurancebrokerage,accordingtothe law on non-life insurance
9) Businessesrelatedto,supportingornecessary for the operation of securities business or derivatives business
10) Freelancers who are not Thai nationality with special skills (High Professional Level) providing services in businesses related to the target industry (workation) such as automotive industry, electronic industry, digital industry, industry that supports the circular economy or other industries, etc.
A study and revision of the aforementioned business types will be carried out. The Commission considered by gathering the information, the criteria which will include information about business’s structure and condition, business’s potential and capability of Thai entrepreneurs and comparison between pros and cons of entering into the market of foreign investors of such business. Also listening to the opinion of stakeholders in the reviewed business in order to make the decision of revision suitable for trade and investment conditions of the country.
