when is it discrimination?
Employers may enforce grooming standards
(such as “no beards”).
Employers may forbid political expression in the workplace.
Employers may limit religious expression (not required by that religion) in the workplace.
Employers may impose a dress code (such as “no shorts, bare bellies, or flip flops”).
Employers may enforce a no-pets policy at work.
In the US, employers are permitted to enforce their own standards for dress, makeup, body modifications, and grooming, but religious practices are protected, and several states prohibit discrimination based on Black hair texture or style. This visual guide gives a sense of what types of expression or states of being are protected by US anti- discrimination laws and which ones aren’t. This illustration isn’t legal advice, just a quick take on some possible scenarios.
