2018 Oklahoma Futurity and Derby Expanded Testing Conditions
Added Money and Conditions Subject to OHRC Approval
In addition to Paragraph 2 of these Race Conditions and as a condition for participation in this race, and subject to approval of the OHRC in accordance with 325:45-1-7, all horses nominated to OQHRA Administered futurities or derbies may be subject to drug testing by the OHRC. Any prohibited medication positives may result in loss of eligibility to participate in trials or finals as determined by OHRC Stewards. If pre-race examination or drug testing prior to or following a race is refused by owner or trainer of eligible horse and results in the horse being ineligible to participate there will be no refund of payments.
DRUG TESTING. All owners of nominated horses hereby agree and acknowledge their agreement with the payment of appropriate fee to nominate each horse and the required drug testing for each horse nominated to this race program. Nomination and payment of fees is an agreement that they willingly participate and will cooperate in collection of samples for out of competition (OOCT) testing initiated by OQHRA as race sponsor. In the event of an ownership transfer at any time prior to the trials, the new owner must comply with the testing conditions for the eligible horse or the horse will be disqualified and ineligible to enter trials and the new owner will not be entitled to any refund of fees paid to date. Testing in accordance with this condition is not supervised by or under the regulatory authority of the OHRC. All sample collecting and testing will be conducted by Laboratories and Veterinary service providers contracted by OQHRA as race sponsor. All eligible horses will be tested and each owner will be notified of their entry’s eligibility to participate in the trials based on the test results prior to publication of the final eligibility list provided to the racetrack. Any horse not on that list will not be eligible for entry into trials this race and the determination is not subject to an appeal to either the track or the racing commission.
In addition to the nomination and sustaining payments in accordance with the payment schedule, at the time a horse is originally nominated each owner or nominator must pay a drug testing fee of $ 350.00 in addition to the scheduled payment to be eligible for the race. The purpose of testing is to disqualify horses testing positive for prohibited substances including but not limited to blood doping agents, Clenbuterol, Zilpaterol, Ractopimine, animal venoms, growth hormones, anabolic steroids, and other drugs or substances that do not have a permitted threshold level in Oklahoma. Out of Competition Testing will be conducted by a Laboratory selected by OQHRA as the race sponsor. Collection of samples will be conducted by a veterinary service selected by OQHRA as the race sponsor. For the purposes of this section, testing may be performed on any biological sample including but not limited to blood, urine, hair, tissue, or saliva that is taken from the nominated horse. The collection of samples from each eligible horse will include two biologic samples from each horse, type of sample to be determined by OQHRA at time of collection and all horses will be tested using the same type of sample. Each horse will be identified by a qualified individual prior to collection of the samples as determined by OQHRA as race sponsor. No owner, trainer or other person having the care of an eligible horse shall refuse to present the horse for collection of the samples at such time and location directed by the OQHRA as the race sponsor. Horses must be timely produced for testing at the location designated by OQHRA. Failure to present a horse for testing or to cooperate with the testing process will result in the horse being disqualified and ineligible to start in trial or participate in the final. The laboratory will report to OQHRA only that the results are negative or positive. All results of testing will be completely confidential and the individual results of each horse will not be reported to the owner. The owner will only be notified that the horse is eligible to enter or ineligible to enter.
Horses that are declared ineligible to enter will not receive a refund of any payments made prior to the time the horse is tested and will be disqualified and ineligible to enter for trials. All horses remaining eligible as a result of a nomination or sustaining payment on or before the due date for the January payment will be tested after the January payment deadline, and prior to the deadline for the February payment. In the event results are unavailable prior to the February payment deadline and a horse has remitted the February payment prior to notification of a positive report from testing, that owner may be eligible for a refund of the February payment. In the event testing of all horses as specified in this paragraph is not performed due to unforeseen circumstances, the Drug Testing fees will be added to the Net Purse for the final.
