Independent Contractors & the Sharing Economy
Uber and Lyft are the latest in a long series of high-profile independent contractor misclassification class actions to sweep California. Recent decisions from the EDD, the Ninth Circuit, and California’s Court of Appeal all indicate a concerted movement toward limiting California companies’ ability to utilize independent contractors. Yet, the sharing economy, such as Uber and Instacart, often utilize this model, demonstrating it remains the employment classification of choice for Silicon Valley tech companies, and beyond.
