Sealed proposals received only at the Dinuba City Hall, 405 E. El Monte Way, Dinuba, CA 93618, until Wednesday. July 17, 2019 at 1:30 PM, and promptly thereafter all proposals duly received will be publically opened and read aloud for the said project according to the

No contract will be awarded to a Contractor who has not been li- censed in accordance with provisions of Chapter 9 of Division 3 of the State of California Business and Professions Code. This project requires the Contractor to have a Class A or a combination of Class C license to perform all aspects of work.
All Contractors and/or subcontractors shall be required to obtain a City of Dinuba business license and encroachment permit. No pay- ment will be made to any Contractor until such license and permit is obtained.
A bid will not be considered unless it is made on a proposal form fur- nished by the City The bid Speci cation document must be submitted in its entirety with no pages removed. Each bid must be accompa- nied by cash, cashier’s check, certi ed check, or bidder’s bond made payable to the City for an amount equal to at least ten percent (10%) of the total amount of bid, such guaranty to be forfeited should the bidder to whom the contract is awarded fail to enter into the Contract. The special attention of prospective bidders is called to the “Proposal Requirements and Conditions” annexed to the blank form of propos- al, for full directions as to bidding, etc.
The U.S. Department of Transportation (DOT) provides a toll-free “hotline” service to report bid rigging activities. Bid rigging activities can be reported Mondays through Fridays, between 8:00 a.m. and 5:00 p.m., Eastern Time, Telephone No. 1-800-424-9071. Anyone with knowledge of possible bid rigging, bidder collusion, or other fraudulent activities should use the “hotline” to report these activi- ties. The “hotline” is part of the DOT’s continuing effort to identify and investigate highway construction contract fraud and abuse and is operated under the direction of the DOT Inspector General. All information will be treated con dentially, and caller anonymity will be respected.
Pursuant to Section 22300 of the California Government Code (Sec- tion 10263 of the Public Contract Code for State Agencies), the Con- tractor may substitute securities for any money held by the Owner to insure performance of the Contract. At the request and expense of the Contractor, securities equivalent to the amount withheld shall be deposited with the School District or with a State or Federally char- tered bank as an escrow agent, who shall return such securities to the Contractor upon satisfactory completion of the contract. Deposit of securities with an escrow agent shall be subject to written agree- ment in accordance with the provisions of Section 22300. The City shall not certify that the Contract has been completed until at least thirty- ve (35) days after  ling by the City of a Notice of Completion. Securities eligible for investment under this Section shall be limited to those listed in Section 16430 of the California Government Code, bank or savings and loan certi cates of deposit, interest bearing de- mand deposit accounts, standby letters of credit, or any other security mutually agreed upon by the Contractor and the public agency. Federal minimum wage rates, as predetermined by the U.S. Depart- ment of Labor, are available on the following website: www.wdol.gov/ dba.aspx. If there is a difference between the federal minimum wage rates predetermined by the U.S. Department of Industrial Relations of the State of California for similar classi cations of labor, the Con- tractor and his subcontractors shall pay no less than the higher wage rate.
This project is subject to the “Buy America” provisions of the Surface Transportation Assistance Act of 1982 as Amended by the Intermodal Surface Transportation Ef ciency Act of 1991.

Plans and speci cations can be examined at the of ce of the Director of Public Works at 1088 E. Kamm Avenue, Dinuba, California 93618 Planholder names may be obtained only from the City Engineer, be- ginning six working days prior to the date of bid opening.
Scope of Work: The project consists of constructing concrete curb bulbouts in the intersection of Kamm Ave. and Greene Ave. In doing so, existing asphalt pavement, concrete, signage, striping, and mark- ings will need to be reconstructed. Additionally, there will be a modi-  cation of the existing rectangular rapid  ashing beacon and pedes- trian crossings. The construction, as shown in the construction plans, will also include installation of new underground storm drain utilities. State Department of Transportation Legal Relations and Responsibil- ity Speci cations that apply to the Project are required. These re- quirements include but are not limited to, State Prevailing Wage and Bene t Determinations, Fair Labor Standards, Nondiscrimination, Labor Code, Certi ed Payroll Records, and Disadvantaged Business Enterprise Goals. The School District af rms that in any contract en- tered into pursuant to this advertisement, disadvantaged business enterprises will be afforded full opportunity to submit bids in response to this invitation.
This contract is subject to state contract nondiscrimination and com- pliance requirements pursuant to Government Code, Section 12990. Inquiries or questions based on alleged patent ambiguity of the plans, speci cations or estimate must be communicated as a bidder inquiry prior to bid opening. Any such inquiries or questions, submitted after bid opening, will not be treated as a bid protest. This project will be subject to all applicable Federal and State Wage Determinations. The Contractor will be responsible for paying wages from the Federal and State Wage Determinations for all trades. The wages are set forth in the General Prevailing Wage Rates for this project, available from the following website links: http://www.dir. ca.gov/dlsr/PWD/index.htm and http://www.wdol.gov/dba.aspx#0. See Section 5.7 for additional requirements. Where both State and Federal prevailing wages apply the Contractor shall be required to pay the greater amount.
Bids are required for the entire project, complete and in place. The project, if awarded, will be based upon all work contemplated in the Total Bid. The City further reserves the right to delete such portions of the work as it deems necessary and expedient and the right to perform such portions of the work as it deems necessary to expedite the completion of the project.
All bids are to be compared on the basis of the total base bid. The City reserves the right to reject any or all bids and to waive any in- formality in any bid received not affected by law. Proposals received after the time announced for the bid opening will not be considered. No bidder may withdraw their bid after the time announced for the bid opening.
