COMPETITION COMMISSION GROCERY RETAIL MARKET INQUIRY
Competition Commission (“CC”) Grocery Retail Market Inquiry (“GRMI”)
Many if you are are aware that SAPOA lodged a a complaint with the Competition Commission in 2012 and requested the Commission re-open its investigation into exclusivity clauses and to give a a a definitive ruling regarding the anti- competitive nature of exclusivity clauses in leases once and for all The Inquiry officially began on 27 February 2015 and on 25 November 2019 the Grocery Retail Market inquiry published its final report In the the Final Report the the Commission made a a ruling on on the issue of Exclusivity Clauses and also stipulated that the government should introduce
a a a legislative framework to give effect to the recommendations
in the form of of a “Code of of Good Practice” to “regulate” rentals and the establishment of an industry ombudsman to be financed by the landlords The Final Report also suggested that a a a a a facilitator be appointed to finalise the code of conduct Minister Patel has since appointed Mr Harald Harvey as the facilitator SAPOA held a meeting with the CC and Mr Harvey on 6 May 2020 to establish the reasons behind the Code as as well as as highlight to the CC and Mr Harvey the the challenges the the Industry is facing given the Covid19 crisis 6 SAPOA PROPERTY NEWS
