Act of 2008 (7 U.S.C. 2011 et seq.), there are hereby appropriated $400,000,000, which shall remain available until September 30, 2011.
(b) ALLOCATION OF FUNDS.—Funds described in subsection (a) shall be made available as grants to State agencies as follows— (1) 75 percent of the amounts available shall be allocated to States based on the share of each State of households that participate in the supplemental nutrition assistance program as reported to the Department of Agriculture for the most recent 12-month period for which data are available, adjusted by the Secretary (as of the date of enactment) for participation in disaster programs under section 5(h) of the Food and Nutri-
tion Act of 2008 (7 U.S.C. 2014(h));
(2) 25 percent of the amounts available shall be allocated
to States based on the increase in the number of households that participate in the supplemental nutrition assistance pro- gram as reported to the Department of Agriculture over the most recent 12-month period for which data are available, adjusted by the Secretary (as of the date of enactment) for participation in disaster programs under section 5(h) of the Food and Nutrition Act of 2008 (7 U.S.C. 2014(h)); and
(3) Not later than 60 days after the date of enactment of this Act, the Secretary shall make available to States amounts based on paragraphs (1) and (2) of this subparagraph. (c) REALLOCATION OF FUNDS.—Funds unobligated at the State
level in fiscal year 2010 may be recovered and reallocated to the States in fiscal year 2011.
(d) EMERGENCY DESIGNATION.—Amounts in this section are designated as emergency requirements and necessary to meet emer- gency needs pursuant to sections 403 and 423(b) of S. Con. Res. 13 (111th Congress), the concurrent resolution on the budget for fiscal year 2010.
SEC. 1003. (a) AMENDMENTS TO SECTION 119 OF TITLE 17, UNITED STATES CODE.—
(1) IN GENERAL.—Section 119 of title 17, United States Code, is amended—
(A) in subsection (c)(1)(E), by striking ‘‘December 31, 2009’’ and inserting ‘‘February 28, 2010’’; and
(B) in subsection (e), by striking ‘‘December 31, 2009’’ and inserting ‘‘February 28, 2010’’.
(2) TERMINATION OF LICENSE.—
(A) TERMINATION.—Section 119 of title 17, United States Code, as amended by paragraph (1), shall cease to be effective on February 28, 2010.
(B) CONFORMING AMENDMENT.—Section 4(a) of the Sat- ellite Home Viewer Act of 1994 (17 U.S.C. 119 note; Public Law 103–369) is repealed.
(b) AMENDMENTS TO COMMUNICATIONS ACT OF 1934.—Section 325(b) of the Communications Act of 1934 (47 U.S.C. 325(b)) is amended—
(1) in paragraph (2)(C), by striking ‘‘December 31, 2009’’ and inserting ‘‘February 28, 2010’’; and
(2) in paragraph (3)(C), by striking ‘‘January 1, 2010’’ each place it appears in clauses (ii) and (iii) and inserting ‘‘March 1, 2010’’.
