The Ethical Lawyer: A Caribbean Perspective
The legal profession has traditionally been described as “a noble profession”. Yet, the high incidence of ethical violations by attorneys-at-law has led to some amount of notoriety for the profession. At the same time, in spite of the significant number of obligations imposed on lawyers, there has been a lacuna in the available literature for attorneys practising in the Caribbean. As the legal profession continues to expand, the challenges facing lawyers are likely to rise commensurately. It is therefore important for the jurisprudence in this area to be enhanced.
Edited by Shazeeda Ali (Sweet & Maxwell, London 2015), the book, The Ethical Lawyer: A Caribbean Perspective, represents the culmination of research into this diverse and dynamic area of the law. It comprises a collection of chapters written by experts in the field, including local and regional academics, judges and practitioners, all of whom collaborated with Ali to produce this work. Each chapter seeks to examine a specific and discrete ethical concern that legal professionals encounter.
The introductory chapter, written by Ali, is entitled “The Ethical Lawyer- Taking the Straight and Narrow Path”. This piece seeks to explore some of the reasons why the legal profession has fallen into disrepute. It examines the various forms of legal malpractices through the lens of the following trilogy:
1. Lawyers who cheat their clients.
2. Lawyers who cheat to help their clients win their cases.
3. Lawyers who help their clients cheat others.
