2.4 Can the West legally confiscate the CBR’s $300bn of frozen funds to rebuild Ukraine?
The EU has set up a working group to explore ways in which Russia's frozen Central Bank funds can be used to rebuild Ukraine. There are several proposals on the table, including outright confiscation, taking temporary custody of the reserves, investing them and putting the returns into Ukraine's reconstruction fund, using CBR reserves as collateral for new Ukrainian public debt, and holding the reserves hostage until Russia agrees to pay reparations.
Although the idea of Russia paying for the reconstruction of Ukraine is clear-cut, difficult questions arise in terms of complying with EU and
